It is an editor's brief statement of the essential features of the measure as introduced. Requires Water Resources Director to designate Water Resources Department employee as policy advisor to perform certain duties with regard to Umatilla Basin and other basins. Declares emergency, effective July 1, 2011. A BILL FOR AN ACT Relating to the Water Resources Department; creating new provisions; amending section 46, chapter 907, Oregon Laws 2009; and declaring an emergency. Be It Enacted by the People of the State of Oregon: SECTION 1. { + (1) The Water Resources Director shall designate an employee of the Water Resources Department to act as a policy advisor for the department on matters pertaining to the Umatilla Basin and other basins. (2) The duties of the policy advisor shall include, but need not be limited to: (a) Overseeing the administration of grant and loan programs under ORS 541.600 to 541.641 and 541.700 to 541.855 and sections 20, 25 and 26, chapter 907, Oregon Laws 2009, with regard to water projects located in the Umatilla Basin; (b) Working with persons and entities that receive funding from lottery bond proceeds for aquifer recharge projects within the Umatilla Basin, and with federal agencies and the Confederated Tribes of the Umatilla Indian Reservation, to further the carrying out of those aquifer recharge projects; and (c) Working with stakeholders, federal agencies and the Confederated Tribes of the Umatilla Indian Reservation to further the resolution of the confederated tribes' water claims within the Umatilla Basin and the Walla Walla Basin. (3) Duties that the director may assign to the policy advisor include, but need not be limited to: (a) Overseeing the implementation of policy and the coordination of staffing and other department resources with regard to water development project planning, funding and development; and (b) Assisting the director in prioritizing basins for the use of department resources and for recommending legislative action related to the integrated state water resources strategy. + } SECTION 2. Section 1 of this 2011 Act is amended to read: { + Sec. 1. + } (1) The Water Resources Director shall designate an employee of the Water Resources Department to act as a policy advisor for the department on matters pertaining to the Umatilla Basin and other basins. SECTION 3. Section 46, chapter 907, Oregon Laws 2009, is amended to read: { + Sec. 46. + } (1) { - Sections 18 to 27 of this 2009 Act - } { + ORS 541.600, 541.611, 541.616, 541.621, 541.631, 541.636 and 541.641 and sections 20, 25 and 26, chapter 907, Oregon Laws 2009, + } and the amendments to ORS 541.700, 541.705, 541.710, 541.720, 541.730, 541.740, 541.765, 541.770, 541.785, 541.830, 541.845 and 541.850 by sections 3 to 14 { + , chapter 907, Oregon Laws 2009, + } { - of this 2009 Act - } apply to loans from the Water Development Fund for which an application is filed on or after April 1, 2010. (2) The repeal of ORS 541.755 by section 15 { + , chapter 907, Oregon Laws 2009, + } { - of this 2009 Act - } becomes operative April 1, 2010. (3) The amendments to ORS { + 541.616, 541.641, + } 541.705, 541.710, 541.720, 541.765, 541.785, 541.830 and 541.850 { - and sections 21 and 27 of this 2009 Act - } by sections 35 to 43 { + , chapter 907, Oregon Laws 2009, + } { - of this 2009 Act - } become operative January 2, 2024. { + (4) The amendments to section 1 of this 2011 Act by section 2 of this 2011 Act become operative January 2, 2024. + } SECTION 4. { + This 2011 Act being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this 2011 Act takes effect July 1, 2011. + } ----------
