petition or prospective petition for state measure to be
initiated.

A BILL FOR AN ACT
Relating to signature sheets for state measures to be initiated;
creating new provisions; amending ORS 260.558 and 260.993; and
declaring an emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1. ORS 260.558 is amended to read:
260.558. (1) { + (a) + } It is unlawful to offer, pay or
provide money or other valuable consideration to another person
to sign or refrain from signing an initiative, referendum or
recall petition, and for the other person to accept or agree to
accept money or other valuable consideration for signing or
refraining to sign an initiative, referendum or recall petition.
{ - (2) - } { + (b) + } It is unlawful to sell, offer to
sell, purchase or offer to purchase, for money or other valuable
consideration, any signature sheet of an initiative, referendum
or recall petition or any other portion of the petition used to
gather signatures.
{ - (3) - } { + (c) + } This { - section - } { +
subsection + } applies only to signatures, signature sheets or
other portions of an initiative, referendum or recall petition to
be submitted to the filing officer for the purpose of verifying
whether the petition contains the required number of signatures
of electors.
{ + (2) It is unlawful to provide postage prepaid on, or
provide an envelope with postage prepaid for, any signature sheet
for a petition or prospective petition for a state measure to be
initiated. + }
SECTION 2. ORS 260.993 is amended to read:
260.993. (1) The penalty for violation of ORS 260.532 is
limited to that provided in ORS 260.532 (6) and (8).
(2) Violation of ORS 247.125 (1), 247.171 (5), 247.420 (2),
253.710, 260.402, 260.555, 260.558 { + (1) + }, 260.575, 260.645
or 260.665 (2) or (3) involving any action described in ORS
260.665 (2)(d) to (f) or 260.715 is a Class C felony.
(3) Violation of ORS 260.695 (4) is a Class A misdemeanor.
(4) Violation of ORS 247.171 (6) is a Class C misdemeanor.
SECTION 3. { + The amendments to ORS 260.558 and 260.993 by
sections 1 and 2 of this 2011 Act apply to signature sheets
circulated or signed on or after the effective date of this 2011
Act. + }
SECTION 4. { + This 2011 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2011 Act takes effect on its
passage. + }
