SUMMARY

brief statement of the essential features of the measure as
introduced.
Requires county clerk in county that maintains list of wedding
officiants to include name and other contact information of
wedding officiant as requested. Limits requests to wedding
officiants who reside in county, have not been convicted of
felony or misdemeanor involving dishonesty and served for one
year or more as county clerk or judge pro tempore in county in
which request made.
Declares emergency, effective on passage.
A BILL FOR AN ACT
Relating to lists maintained by counties of persons authorized to
solemnize marriages; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + (1) In each county that maintains a list of
wedding officiants, upon request of a wedding officiant, the
county clerk shall include within the list the wedding
officiant's name and such contact information as the wedding
officiant submits for inclusion within the list.
(2) This section applies to a wedding officiant who:
(a) Is authorized to solemnize marriages under ORS 106.120;
(b) Resides in the county in which a request under subsection
(1) of this section is made; and
(c) Demonstrates to the reasonable satisfaction of the county
clerk that the individual:
(A) Has not been convicted of a felony or a misdemeanor
involving dishonesty; and
(B) Served in a full-time capacity for one year or more in the
county in which the request is made, as:
(i) The county clerk; or
(ii) A judge pro tempore of the circuit court.
(3) Nothing in this section limits the authority of a county
clerk to include within the list the names and contact
information of individuals other than wedding officiants
described in subsection (2) of this section who are authorized to
solemnize marriages under ORS 106.120.
(4) This section applies to lists whether published in print or
on the Internet, including Internet links to external Internet
websites containing contact information for wedding
officiants. + }
SECTION 2. { + This 2013 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2013 Act takes effect on its
passage. + }
