                             SUMMARY

The following summary is not prepared by the sponsors of the
measure and is not a part of the body thereof subject to
consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure as
introduced.

  Provides civil immunity to education providers, and officers,
employees and agents of education providers, for acts or
omissions of education provider in attempting to prevent suicide
by students. Exempts intentional torts and acts or omissions that
constitute gross negligence.

                        A BILL FOR AN ACT
Relating to liability.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + (1) Except as provided in subsection (2) of
this section, an education provider, as defined in ORS 339.370,
and all officers, employees and agents of the education provider,
are immune from civil liability for all acts or omissions of the
education provider in attempting to prevent suicide by students.
  (2) This section does not apply to intentional torts or to acts
or omissions that constitute gross negligence. + }
  SECTION 2.  { + (1) Except as provided in subsection (2) of
this section, section 1 of this 2011 Act applies to all acts or
omissions, whether occurring before, on or after the effective
date of this 2011 Act.
  (2) Section 1 of this 2011 Act does not apply to a cause of
action for which a judgment was entered before the effective date
of this 2011 Act. + }
