                             SUMMARY

  Allows student at community college or state institution of
higher education to recover from school district costs of
remedial education course.

                        A BILL FOR AN ACT
Relating to remedial education.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + (1) As used in this section:
  (a) 'Cost' means the combined tuition and purchase price of
required books and other course materials for a remedial
education course.
  (b) 'Remedial education course' means a post-secondary course
designated by a community college or a state institution of
higher education listed in ORS 352.002 that is designed to bring
underprepared students to the level of skill competency expected
of an incoming first-year college student.
  (2) A student enrolled at a community college or state
institution of higher education listed in ORS 352.002 may recover
from a school district in this state the cost of a remedial
education course if the student received a high school diploma
from a school in the school district no more than two years
before the beginning of the term in which the student was
enrolled in the remedial education course.
  (3) To recover the cost of a remedial education course, a
student shall apply to the Department of Education. If the
department approves the student's application, the department
shall pay the student's cost from the State School Fund. The
department shall then deduct the amount paid to the student from
the State School Fund grant, computed as provided in ORS 327.011
and 327.013, that is next scheduled pursuant to ORS 327.095 to be
distributed to the school district that is obligated to
compensate the student under subsection (2) of this section.
  (4) The department shall adopt rules to implement this
section. + }

2012-2013 school year. + }
