                             SUMMARY

The following summary is not prepared by the sponsors of the

brief statement of the essential features of the measure.

    { - Requires permit for operation of motor vehicle with
studded tires. Specifies how Department of Transportation is to
determine cost of permit. - }
    { - Creates traffic offense of operating motor vehicle with
studded tires without permit. Punishes by maximum fine of
$500. - }
   { +  Requires Department of Transportation to study impact of
studded tires on highway maintenance cost and to report results
to Legislative Assembly. + }

                        A BILL FOR AN ACT
Relating to studded tires; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + (1) The Department of Transportation shall
study and submit a report on the impact of the use of studded
tires on the cost of maintaining highways as defined in ORS
366.005. The report must include:
  (a) The annual cost of highway maintenance attributed to the
impact of the use of studded tires, including but not limited to
the cost of early pavement replacement due to damage caused by
the use of studded tires and a breakdown of these costs as
distributed among city streets, county roads and state highways.
  (b) The approximate number of studded tires and other types of
traction tires or traction devices used in this state during the
winter driving season and a description of regional variations in
use.
  (c) The net reduction in pavement surface life due to the use
of studded tires.
  (d) A description of how different types of pavement surfaces
are affected by the use of studded tires.
  (e) A review of recent studies conducted in other states
regarding the safety benefits of snow tires and studded tires
under different winter driving conditions.
  (f) A review of recent studies conducted in other states
regarding the need for studded tires to provide traction in
winter driving conditions.

  (g) A discussion of recent improvements in traction tire design
and whether the improvements reduce damage to highways.
  (h) A description of different types of traction tires and
traction devices used in different regions of this state.
  (i) Recommended alternative measures that road authorities
could implement to reduce the use of studded tires while
maintaining safe driving conditions, including educating the
public about alternatives to studded tires.
  (j) The anticipated annual cost of alternative measures that
road authorities may implement to maintain safe driving
conditions as a result of a ban on studded tires.
  (k) A review of recent studies conducted in other states
regarding the frequency of motor vehicle crashes as a result of a
ban on studded tires and the costs associated with an increase or
decrease in the frequency of crashes.
  (2) In conducting the study, the department shall consult with
the Oregon Transportation Research and Education Consortium,
Oregon State University, cities, counties and persons in the tire
industry.
  (3) The department shall report the findings of the study to
the 2015 regular session of the Legislative Assembly in the
manner prescribed by ORS 192.245. + }
  SECTION 2.  { + Section 1 of this 2013 Act is repealed on
January 2, 2016. + }
  SECTION 3.  { + This 2013 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2013 Act takes effect on its
passage. + }
