                             SUMMARY

The following summary is not prepared by the sponsors of the
measure and is not a part of the body thereof subject to
consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure as
introduced.

  Prohibits certain persons from simultaneously holding more than
three permits issued pursuant to restricted vessel permit system.
Specifies conditions related to transfer of certain permits
issued pursuant to restricted vessel permit system.
  Declares emergency, effective on passage.

                        A BILL FOR AN ACT
Relating to commercial fishing; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
  SECTION 1. { +  Sections 2 and 3 of this 2011 Act are added to
and made a part of ORS chapter 508. + }
  SECTION 2.  { + A canner of food fish, a wholesale fish dealer,
a fish buyer or an individual taking or assisting in the taking
of food fish for commercial purposes, licensed as required under
ORS 508.035, may simultaneously hold no more than three permits
issued in each restricted vessel permit system for commercial
fishing specified in this chapter. + }
  SECTION 3.  { + (1) Notwithstanding section 2 of this 2011 Act
or any other provision of the commercial fishing laws, if a
person described in section 2 of this 2011 Act holds more than
three permits issued in a restricted vessel permit system
specified in this chapter on the effective date of this 2011 Act,
the person may renew and use no more than three of the permits in
each restricted vessel permit system, and may renew but not use
permits in excess of three in each restricted vessel permit
system.
  (2) A person may transfer any permits that the person renews
but does not use under subsection (1) of this section if the
transfer is complete by December 31, 2013. Any permits in excess
of three in each restricted vessel permit system not transferred
by December 31, 2013, may not be renewed.
  (3) A person may not transfer a permit under this section to
any relative, as defined in ORS 95.200, or to any person who has
a financial interest in the person's activities connected with
the permits. + }
  SECTION 4.  { + Section 2 of this 2011 Act applies to permits
issued pursuant to a restricted vessel permit system, except for
permits issued pursuant to ORS 508.775 for the Columbia River
gillnet salmon fishery and for permits issued pursuant to ORS

508.801 for the ocean troll salmon fishery, before, on or after
the effective date of this 2011 Act. + }
  SECTION 5.  { + This 2011 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2011 Act takes effect on its
passage. + }
