                             SUMMARY

The following summary is not prepared by the sponsors of the
measure and is not a part of the body thereof subject to
consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure as
introduced.

  Requires that final order of state agency in contested case
proceeding include copy of statutes relating to appeal of order
and notification of right of party to request leave to present
additional evidence on appeal.

                        A BILL FOR AN ACT
Relating to orders in contested cases; creating new provisions;
  and amending ORS 183.470.
Be It Enacted by the People of the State of Oregon:
  SECTION 1. ORS 183.470 is amended to read:
  183.470. In a contested case:
  (1) Every order adverse to a party to the proceeding shall be
in writing or stated in the record and may be accompanied by an
opinion.
  (2) A final order shall be accompanied by findings of fact and
conclusions of law. The findings of fact shall consist of a
concise statement of the underlying facts supporting the findings
as to each contested issue of fact and as to each ultimate fact
required to support the agency's order.
  (3) The agency shall notify the parties to a proceeding of a
final order by delivering or mailing a copy of the order and any
accompanying findings and conclusions to each party or, if
applicable, the party's attorney of record.
  (4) Every final order shall include a   { - citation of the
statutes under which the order may be appealed - }  { +  a copy
of ORS 183.480 and 183.482 and shall notify the party of the
party's right to request leave to present additional evidence
under ORS 183.482 (5) + }.
  SECTION 2.  { + The amendments to ORS 183.470 by section 1 of
this 2013 Act apply only to final orders issued under ORS 183.470
on or after the effective date of this 2013 Act. + }
