                             AN ACT

Relating to state agency employees; and declaring an emergency.

Be It Enacted by the People of the State of Oregon:

  SECTION 1.  { + (1) The Oregon Department of Administrative
Services shall develop a plan for agencies of state government
that employ more than 100 employees to attain a ratio of 11 to 1
of public employees to supervisory employees and managerial
employees acting in a supervisory capacity. The plan shall be
used to develop the legislatively adopted budget and may provide
for a transition to the ratio specified in this subsection during
a period lasting more than one biennium.
  (2)(a) As part of the development of the legislatively adopted
budget, during each odd-numbered year regular session of the
Legislative Assembly, the department shall report on the plan
developed under subsection (1) of this section to the Joint
Committee on Ways and Means.
  (b) The report required under this subsection shall also
include:
  (A) The ratio of public employees to supervisory employees;
  (B) The ratio of public employees to managerial employees; and
  (C) The number of positions authorized for managerial employees
who do not act in a supervisory capacity and a description of the
duties assigned to those positions.
  (3) As used in this section:
  (a) 'Legislatively adopted budget' means the budget enacted by
the Legislative Assembly during an odd-numbered year regular
session.
  (b) 'Managerial employee' has the meaning given that term in
ORS 243.650.
  (c) 'Public employee' has the meaning given that term in ORS
243.650.
  (d) 'State government' means every state officer, board,
commission, department, institution, branch or agency whose costs
are paid wholly or in part from funds held in the State Treasury.
  (e) 'Supervisory employee' has the meaning given that term in
ORS 243.650. + }

  SECTION 2.  { + Section 1 of this 2011 Act first applies to the
legislatively adopted budget for the biennium beginning July 1,
2013. + }
  SECTION 3.  { + The Oregon Department of Administrative
Services shall report to the Joint Committee on Ways and Means
during the 2012 regular session of the Legislative Assembly on
the ratio of public employees to supervisory employees or
managerial employees acting in a supervisory capacity. + }
  SECTION 4.  { + Section 3 of this 2011 Act is repealed on
January 2, 2013. + }
  SECTION 5.  { + This 2011 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2011 Act takes effect on its
passage. + }
