SUMMARY

introduced.
Specifies that person or state agency may not produce, raise or
release fish that is not native fish unless person or state
agency produces, raises or releases fish that is not native fish
in waters of this state in area specified in rules adopted by
State Fish and Wildlife Commission.
Declares emergency, effective on passage.
A BILL FOR AN ACT
Relating to fish; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + Section 2 of this 2011 Act is added to and made
a part of ORS chapter 498. + }
SECTION 2. { + (1) As used in this section:
(a) 'Native fish' means fish that are indigenous to Oregon and
not introduced. Naturally produced or raised fish and hatchery
produced or raised fish are both native fish if the fish are
indigenous to Oregon and not introduced.
(b) 'Waters of this state' has the meaning given that term in
ORS 506.006.
(2) In order to protect the habitat of native fish, a person or
a state agency may not produce, raise or release a fish that is
not a native fish in the waters of this state unless the person
or state agency produces, raises or releases the fish in the
waters of this state in an area specified in rules adopted by the
State Fish and Wildlife Commission. + }
SECTION 3. { + (1) Except as provided in subsection (2) of
this section, section 2 of this 2011 Act becomes operative on
January 1, 2012.
(2) Before the operative date specified in subsection (1) of
this section, the State Fish and Wildlife Commission may adopt
rules or take any other action that is necessary to implement, on
or after the operative date specified in subsection (1) of this
section, section 2 of this 2011 Act. + }
SECTION 4. { + This 2011 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2011 Act takes effect on its
passage. + }
