A BILL
To amend section 101.27 of the Revised Code to reduce 1
temporarily salaries of General Assembly members 2
by up to ten per cent.3


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 101.27 of the Revised Code be amended 4
to read as follows:5

       Sec. 101.27.  (A)(1) Every member of the senate, except the 6
members elected president, president pro tempore, assistant 7
president pro tempore, majority whip, minority leader, assistant 8
minority leader, minority whip, and assistant minority whip, shall 9
receive as compensation a salary of fifty-one thousand six hundred 10
seventy-four dollars a year during the senator's term of office. 11
Every member of the house of representatives, except the members 12
elected speaker, speaker pro tempore, majority floor leader, 13
assistant majority floor leader, majority whip, assistant majority 14
whip, minority leader, assistant minority leader, minority whip, 15
and assistant minority whip, shall receive as compensation a 16
salary of fifty-one thousand six hundred seventy-four dollars a 17
year during the representative's term of office. Such salaries 18
shall be paid in equal monthly installments during such term. All 19
monthly payments shall be made on or before the fifth day of each 20
month. Upon the death of any member of the general assembly during 21
the member's term of office, any unpaid salary due such member for 22
the remainder of the member's term shall be paid to the member's 23
surviving spouse, children, mother, or father, in the order in 24
which the relationship is set forth in this section in monthly 25
installments.26

       (2) Each member shall receive a travel reimbursement per mile 27
each way, at the same mileage rate allowed for the reimbursement 28
of travel expenses of state agents as provided by rule of the 29
director of budget and management pursuant to division (B) of 30
section 126.31 of the Revised Code, for mileage not more than once 31
a week during the session for travel incurred by a member from and 32
to the member's place of residence, by the most direct highway 33
route of public travel to and from the seat of government, to be 34
paid quarterly on the last day of March, June, September, and 35
December of each year.36

       (3) The member of the senate elected president and the member 37
of the house of representatives elected speaker shall each receive 38
as compensation a salary of eighty thousand five hundred 39
forty-nine dollars a year during the president's or speaker's term 40
of office.41

       The member of the senate elected president pro tempore, the 42
member of the senate elected minority leader, the member of the 43
house of representatives elected speaker pro tempore, and the 44
member of the house of representatives elected minority leader 45
shall each receive as compensation a salary of seventy-three 46
thousand four hundred ninety-three dollars a year during the 47
member's term of office. The member of the house of 48
representatives elected majority floor leader and the member of 49
the senate elected assistant president pro tempore shall each 50
receive as compensation a salary of sixty-nine thousand two 51
hundred twenty-seven dollars a year during the member's term of 52
office. The member of the senate elected assistant minority leader 53
and the member of the house of representatives elected assistant 54
minority leader shall each receive as compensation a salary of 55
sixty-seven thousand ninety-nine dollars a year during the 56
member's term of office. The member of the senate elected majority 57
whip and the member of the house of representatives elected 58
assistant majority floor leader shall each receive a salary of 59
sixty-four thousand nine hundred sixty-seven dollars a year during 60
the member's term of office. The member of the senate elected 61
minority whip, the member of the house of representatives elected 62
majority whip, and the member of the house of representatives 63
elected minority whip shall each receive as compensation a salary 64
of sixty thousand seven hundred six dollars a year during the 65
member's term of office. The member of the house of 66
representatives elected assistant majority whip shall receive as 67
compensation a salary of fifty-six thousand four hundred 68
forty-three dollars a year during the member's term of office. The 69
member of the house of representatives elected assistant minority 70
whip and the member of the senate elected assistant minority whip 71
shall each receive a salary of fifty-four thousand sixty dollars a 72
year during the member's term of office.73

       (4) The chairperson of the finance committee of each house 74
shall receive an additional sum of ten thousand dollars annually. 75
The chairperson of each standing committee of each house other 76
than the finance committee shall receive an additional sum of six 77
thousand five hundred dollars annually. The chairperson of each 78
standing subcommittee of a finance committee shall receive an 79
additional sum of six thousand five hundred dollars annually. The 80
vice-chairperson of the finance committee of each house shall 81
receive an additional sum of five thousand five hundred dollars 82
annually. The ranking minority member of the finance committee of 83
each house shall receive an additional sum of six thousand five 84
hundred dollars annually. The ranking minority member of each 85
standing subcommittee of a finance committee shall receive an 86
additional sum of five thousand dollars annually. The chairperson 87
of each standing subcommittee of each house other than a standing 88
subcommittee of the finance committee shall receive an additional 89
sum of five thousand dollars annually. The vice-chairperson and 90
ranking minority member of each standing committee of each house 91
other than the finance committee shall each receive an additional 92
sum of five thousand dollars annually. Except for the ranking 93
minority member of each standing subcommittee of a finance 94
committee, the ranking minority member of each standing 95
subcommittee of each house shall receive an additional sum of two 96
thousand five hundred dollars annually.97

       No member may receive more than one additional sum for 98
serving as chairperson, vice-chairperson, or ranking minority 99
member of a standing committee or standing subcommittee, 100
regardless of the number of standing committees or standing 101
subcommittees on which the member serves as chairperson, 102
vice-chairperson, or ranking minority member.103

       (5) If a member is absent without leave, or is not excused on 104
the member's return, there shall be deducted from the member's 105
compensation twenty dollars for each day's absence.106

       (B) Each calendar year from 2002 through 2008, the salary 107
amounts under divisions (A)(1) and (3) of this section shall be 108
increased by the lesser of the following:109

       (1) Three per cent;110

       (2) The percentage increase, if any, in the consumer price 111
index over the twelve-month period that ends on the thirtieth day 112
of September of the immediately preceding year, rounded to the 113
nearest one-tenth of one per cent.114

       (C) From January 1, 2013 through December 31, 2016, the 115
salary amounts specified in divisions (A)(1) and (3) of this 116
section as they have been increased by division (B) of this 117
section and the additional sums specified in division (A)(4) of 118
this section shall be reduced by the following amounts:119

       (1) If the Ohio unemployment rate is less than the federal 120
unemployment rate on December 31, 2012, five per cent;121

       (2) If the Ohio unemployment rate is more than the federal 122
unemployment rate on December 31, 2012, ten per cent.123

       The salary reductions described in division (C) of this 124
section shall apply only to members whose terms of office commence 125
on or after January 1, 2013. The reductions shall apply through 126
December 31, 2018, to a member of the senate serving a term of 127
office ending not later than that date.128

       (D) As used in this section:129

       (1) "Consumer price index" means the consumer price index 130
prepared by the United States bureau of labor statistics (U.S. 131
city average for urban wage earners and clerical workers: all 132
items, 1982-1984=100), or, if that index is no longer published, a 133
generally available comparable index.134

       (2) "Finance committee" means the finance committee of the 135
senate and the finance-appropriations committee of the house of 136
representatives.137

       "Federal unemployment rate" means the rate determined for the 138
United States by the federal Bureau of Labor Statistics of the 139
United States Department of Labor as part of its monthly "Current 140
Population Survey."141

       "Ohio unemployment rate" means the rate determined for Ohio 142
by the Bureau of Labor Statistics as part of its monthly "Local 143
Area Unemployment Statistics" program.144

       Section 2. That existing section 101.27 of the Revised Code 145
is hereby repealed.146
