To enact section 4731.45 of the Revised Code to | 1 |
require a physician interpreting a mammogram who | 2 |
determines that the patient has dense breast | 3 |
tissue to specify this in the mammography report | 4 |
sent to the patient. | 5 |
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:
Section 1. That section 4731.45 of the Revised Code be | 6 |
enacted to read as follows: | 7 |
Sec. 4731.45. As used in this section, "physician" means an | 8 |
individual authorized by this chapter to practice medicine and | 9 |
surgery or osteopathic medicine and surgery. | 10 |
A physician interpreting a mammogram shall determine based on | 11 |
the breast imaging reporting and data system established by the | 12 |
American college of radiology whether the patient has dense breast | 13 |
tissue. If so, the physician shall include the following in the | 14 |
report or summary sent to the patient pursuant to 21 C.F.R. | 15 |
900.12: | 16 |
"Because your mammogram demonstrates that you have dense | 17 |
breast tissue, which could hide small abnormalities, you might | 18 |
benefit from supplementary screening tests, depending on your | 19 |
individual risk factors. If you specified a physician to receive | 20 |
the report of your mammography results, the report has been sent | 21 |
to your physician's office. Contact your physician if you have any | 22 |
questions or concerns about dense breast tissue or your | 23 |
mammography results." | 24 |
