A BILL
To enact section 5501.35 of the Revised Code to 1
require the Department of Transportation to survey 2
each school district, community school, and STEM 3
school regarding transportation safety and 4
alternative transportation options for students 5
living within two miles of school.6


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 5501.35 of the Revised Code be 7
enacted to read as follows:8

       Sec. 5501.35.  (A) In coordination with the department of 9
transportation's safe routes to school program, the director of 10
transportation shall create a survey regarding school 11
transportation safety policies and the promotion of nonmotorized 12
transportation options for public school students living within 13
two miles of their school of attendance. Each city, local, 14
exempted village, and joint vocational school district, community 15
school established under Chapter 3314. of the Revised Code, and 16
STEM school established under Chapter 3326. of the Revised Code 17
shall complete and return the survey on or before a date specified 18
by the director. The director shall not require a community or 19
STEM school to complete a survey if no student attending the 20
school lives within two miles of the location of the school. The 21
survey shall state the purpose of the survey and provide 22
information on the safe routes to school program. The survey also 23
may seek the following information:24

       (1) The location of each school building operated by the 25
district or school and the percentage of the school's students 26
living within two miles of the school;27

       (2) Whether the district or school has in place any programs 28
relating to transportation safety or the promotion of nonmotorized 29
modes of transportation, such as the use of a crossing guard or 30
participation in a walk to school day; 31

       (3) Whether any safety or traffic study has been completed 32
for the school location, and the results of such a study;33

       (4) Whether the district or school has surveyed students 34
living within two miles of the school's location regarding modes 35
of transportation to the school;36

       (5) Any other factors the director determines to be 37
appropriate.38

       (B) The director shall compile the surveys required in 39
division (A) of this section and publish the findings on the 40
department's web site within ninety days of the effective date of 41
this section. 42
