BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES OF THE STATE OF OHIO
(THE SENATE CONCURRING):
| WHEREAS, Ohio's nursing homes are focused both on serving | 6 |
| residents with long-term care needs and on rehabilitating patients | 7 |
| coming from hospitals following surgery or other treatment for | 8 |
| acute medical conditions before sending them home or to a lower | 9 |
| intensity setting; and | 10 |
| WHEREAS, Patients coming from hospitals often arrive at a | 11 |
| nursing home with considerable pain; and | 12 |
| WHEREAS, Due to federal laws, regulations, and policies, | 13 |
| these patients often are prevented from receiving pain medication | 14 |
| promptly upon transfer to a nursing home and must wait to receive | 15 |
| adequate pain medication while physicians, nurses, and pharmacists | 16 |
| comply with federal requirements pertaining to the administration | 17 |
| of pain medication in nursing homes, including Schedule II | 18 |
| controlled substances; and | 19 |
| WHEREAS, Physicians, nurses, and pharmacists are equally | 20 |
| qualified to manage a patient's pain in a hospital and a nursing | 21 |
| home; now therefore be it | 22 |
| RESOLVED, That we, the members of the 129th General Assembly | 23 |
| of the State of Ohio, urge the Congress of the United States and | 24 |
| the United States Drug Enforcement Administration to change | 25 |
| federal laws, regulations, and policies to allow patients to | 26 |
| receive any needed pain medication promptly when transferred to a | 27 |
| nursing home following a hospital stay for surgery or other | 28 |
| treatment; and be it further | 29 |
| RESOLVED, That the Clerk of the House of Representatives | 30 |
| transmit duly authenticated copies of this resolution to the | 31 |
| Administrator of the United States Drug Enforcement | 32 |
| Administration, to the Speaker and Clerk of the United States | 33 |
| House of Representatives, to the President Pro Tempore and | 34 |
| Secretary of the United States Senate, to the members of the Ohio | 35 |
| Congressional delegation, and to the news media of Ohio. | 36 |
