A BILL
To amend section 4303.231 of the Revised Code to 1
allow a W liquor permit holder to sell and ship 2
beer and wine, on behalf of an S liquor permit 3
holder, to consumers residing in Ohio.4


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 4303.231 of the Revised Code be 5
amended to read as follows:6

       Sec. 4303.231. Permit(A) A W permit may be issued to a 7
manufacturer or supplier of beer or intoxicating liquor to operate 8
a warehouse for the storage of beer or intoxicating liquor within 9
this state and to selldo both of the following:10

       (1) Sell those products from the warehouse only to holders of11
B permitspermit holders in this state and to other customers 12
outside this state under rules adopted by the liquor control 13
commission;14

       (2) Sell and ship beer or wine, on behalf of an S permit 15
holder, to a personal consumer, provided that the W permit holder 16
complies with divisions (B), (C), and (E) of section 4303.232 of 17
the Revised Code in the same manner required for an S permit 18
holder. Each19

       (B)(1) Each B permit holder of a B permit with a supplier 20
registration on file with the division of liquor control may 21
purchase beer or intoxicating liquor if designated by the permit 22
to make those purchases, from the holder of a W permit holder. 23

       (2) Each S permit holder may sell, assign, or otherwise 25
transfer beer or wine to a W permit holder for sale to a personal 26
consumer as authorized by this section.27

       (C) The fee for a W permit is one thousand five hundred 28
sixty-three dollars for each warehouse during the year covered by 29
the permit.30

       (D) As used in this section, "personal consumer" has the same 31
meaning as in section 4303.232 of the Revised Code.32

       Section 2. That existing section 4303.231 of the Revised Code 33
is hereby repealed.34
