BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:
Section 1. That section 9.318 of the Revised Code be enacted | 4 |
to read as follows: | 5 |
Sec. 9.318. A political subdivision required by law to award | 6 |
a contract by competitive bidding may adopt an ordinance or | 7 |
resolution establishing a buy local Ohio program that permits the | 8 |
political subdivision to choose a bid that is not the lowest bid. | 9 |
The bid shall be within three per cent of the lowest bid and the | 10 |
bid shall respond to bid specifications in all material respects | 11 |
and contain no irregularities or deviations from the | 12 |
specifications that would affect the amount of the bid or | 13 |
otherwise give the bidder a competitive advantage. The bidder's | 14 |
principal place of business shall be within the political | 15 |
subdivision that is awarding the contract. The bidder's principal | 16 |
place of business shall be within the county in which the contract | 17 |
will be performed and the bidder shall have a significant Ohio | 18 |
economic presence. | 19 |
As used in this division, "significant Ohio economic | 20 |
presence" means a bidder that: | 21 |
(A) Pays required taxes to this state; | 22 |
(B) Is registered and licensed to do business in this state | 23 |
with the office of the secretary of state; and | 24 |
(C) Has ten or more employees based in this state, or | 25 |
seventy-five per cent or more of its employees based in this | 26 |
state. | 27 |
