A BILL
To amend section 4501.21 and to enact section 1
4503.495 of the Revised Code to create the 2
"Diabetes Awareness" license plate.3


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1.  That section 4501.21 be amended and section 4
4503.495 of the Revised Code be enacted to read as follows:5

       Sec. 4501.21.  (A) There is hereby created in the state 6
treasury the license plate contribution fund. The fund shall 7
consist of all contributions paid by motor vehicle registrants and 8
collected by the registrar of motor vehicles pursuant to sections 9
4503.491, 4503.492, 4503.493, 4503.494, 4503.495, 4503.496, 10
4503.498, 4503.499, 4503.50, 4503.501, 4503.502, 4503.505, 11
4503.51, 4503.522, 4503.523, 4503.524, 4503.525, 4503.526, 12
4503.531, 4503.545, 4503.55, 4503.551, 4503.552, 4503.553, 13
4503.561, 4503.562, 4503.564, 4503.591, 4503.67, 4503.68, 4503.69, 14
4503.701, 4503.71, 4503.711, 4503.712, 4503.713, 4503.72, 4503.73, 15
4503.732, 4503.74, 4503.75, 4503.751, 4503.85, 4503.89, 4503.90, 16
4503.92, and 4503.94 of the Revised Code. 17

       (B) The registrar shall pay the contributions the registrar 18
collects in the fund as follows: 19

        The registrar shall pay the contributions received pursuant 20
to section 4503.491 of the Revised Code to the breast cancer fund 21
of Ohio, which shall use that money only to pay for programs that 22
provide assistance and education to Ohio breast cancer patients 23
and that improve access for such patients to quality health care 24
and clinical trials and shall not use any of the money for 25
abortion information, counseling, services, or other 26
abortion-related activities. 27

       The registrar shall pay the contributions the registrar 28
receives pursuant to section 4503.492 of the Revised Code to the 29
organization cancer support community central Ohio, which shall 30
deposit the money into the Sheryl L. Kraner Fund of that 31
organization. Cancer support community central Ohio shall expend 32
the money it receives pursuant to this division only in the same 33
manner and for the same purposes as that organization expends 34
other money in that fund.35

        The registrar shall pay the contributions received pursuant 36
to section 4503.493 of the Revised Code to the autism society of 37
Ohio, which shall use the contributions for programs and autism 38
awareness efforts throughout the state. 39

       The registrar shall pay the contributions the registrar 40
receives pursuant to section 4503.494 of the Revised Code to the 41
national multiple sclerosis society for distribution in equal 42
amounts to the northwestern Ohio, Ohio buckeye, and Ohio valley 43
chapters of the national multiple sclerosis society. These 44
chapters shall use the money they receive under this section to 45
assist in paying the expenses they incur in providing services 46
directly to their clients.47

       The registrar shall pay the contributions the registrar 48
receives pursuant to section 4503.495 of the Revised Code to the 49
American diabetes association for distribution in equal amounts to 50
each of the Ohio offices of the American diabetes association. The 51
Ohio offices of the association shall use the money for programs 52
and diabetes awareness in this state.53

       The registrar shall pay the contributions the registrar 54
receives pursuant to section 4503.496 of the Revised Code to the 55
Ohio sickle cell and health association, which shall use the 56
contributions to help support educational, clinical, and social 57
support services for adults who have sickle cell disease.58

       The registrar shall pay the contributions the registrar 59
receives pursuant to section 4503.498 of the Revised Code to 60
special olympics Ohio, inc., which shall use the contributions for 61
its programs, charitable efforts, and other activities. 62

       The registrar shall pay the contributions the registrar 63
receives pursuant to section 4503.499 of the Revised Code to the 64
children's glioma cancer foundation, which shall use the 65
contributions for its research and other programs. 66

        The registrar shall pay the contributions the registrar 67
receives pursuant to section 4503.50 of the Revised Code to the 68
future farmers of America foundation, which shall deposit the 69
contributions into its general account to be used for educational 70
and scholarship purposes of the future farmers of America 71
foundation. 72

        The registrar shall pay the contributions the registrar 73
receives pursuant to section 4503.501 of the Revised Code to the 74
4-H youth development program of the Ohio state university 75
extension program, which shall use those contributions to pay the 76
expenses it incurs in conducting its educational activities. 77

        The registrar shall pay the contributions received pursuant 78
to section 4503.502 of the Revised Code to the Ohio cattlemen's 79
foundation, which shall use those contributions for scholarships 80
and other educational activities. 81

       The registrar shall pay the contributions received pursuant 82
to section 4503.505 of the Revised Code to the organization Ohio 83
region phi theta kappa, which shall use those contributions for 84
scholarships for students who are members of that organization. 85

        The registrar shall pay each contribution the registrar 86
receives pursuant to section 4503.51 of the Revised Code to the 87
university or college whose name or marking or design appears on 88
collegiate license plates that are issued to a person under that 89
section. A university or college that receives contributions from 90
the fund shall deposit the contributions into its general 91
scholarship fund. 92

        The registrar shall pay the contributions the registrar 93
receives pursuant to section 4503.522 of the Revised Code to the 94
"friends of Perry's victory and international peace memorial, 95
incorporated," a nonprofit corporation organized under the laws of 96
this state, to assist that organization in paying the expenses it 97
incurs in sponsoring or holding charitable, educational, and 98
cultural events at the monument. 99

       The registrar shall pay the contributions the registrar 100
receives pursuant to section 4503.523 of the Revised Code to the 101
fairport lights foundation, which shall use the money to pay for 102
the restoration, maintenance, and preservation of the lighthouses 103
of fairport harbor. 104

       The registrar shall pay the contributions the registrar 105
receives pursuant to section 4503.524 of the Revised Code to the 106
Massillon tiger football booster club, which shall use the 107
contributions only to promote and support the football team of 108
Washington high school of the Massillon city school district.109

       The registrar shall pay the contributions the registrar 110
receives pursuant to section 4503.525 of the Revised Code to the 111
United States power squadron districts seven, eleven, twenty-four, 112
and twenty-nine in equal amounts. Each power squadron district 113
shall use the money it receives under this section to pay for the 114
educational boating programs each district holds or sponsors 115
within this state.116

       The registrar shall pay the contributions the registrar 117
receives pursuant to section 4503.526 of the Revised Code to the 118
Ohio district Kiwanis foundation of the Ohio district of Kiwanis 119
international, which shall use the money it receives under this 120
section to pay the costs of its educational and humanitarian 121
activities.122

       The registrar shall pay the contributions the registrar 123
receives pursuant to section 4503.531 of the Revised Code to the 124
thank you foundation, incorporated, a nonprofit corporation 125
organized under the laws of this state, to assist that 126
organization in paying for the charitable activities and programs 127
it sponsors in support of United States military personnel, 128
veterans, and their families.129

        The registrar shall pay the contributions the registrar 130
receives pursuant to section 4503.55 of the Revised Code to the 131
pro football hall of fame, which shall deposit the contributions 132
into a special bank account that it establishes and which shall be 133
separate and distinct from any other account the pro football hall 134
of fame maintains, to be used exclusively for the purpose of 135
promoting the pro football hall of fame as a travel destination. 136

        The registrar shall pay the contributions that are paid to 137
the registrar pursuant to section 4503.545 of the Revised Code to 138
the national rifle association foundation, which shall use the 139
money to pay the costs of the educational activities and programs 140
the foundation holds or sponsors in this state. 141

        The registrar shall pay to the Ohio pet fund the 142
contributions the registrar receives pursuant to section 4503.551 143
of the Revised Code and any other money from any other source, 144
including donations, gifts, and grants, that is designated by the 145
source to be paid to the Ohio pet fund. The Ohio pet fund shall 146
use the moneys it receives under this section to support programs 147
for the sterilization of dogs and cats and for educational 148
programs concerning the proper veterinary care of those animals, 149
and for expenses of the Ohio pet fund that are reasonably 150
necessary for it to obtain and maintain its tax-exempt status and 151
to perform its duties. 152

        The registrar shall pay the contributions the registrar 153
receives pursuant to section 4503.552 of the Revised Code to the 154
rock and roll hall of fame and museum, incorporated. 155

        The registrar shall pay the contributions the registrar 156
receives pursuant to section 4503.553 of the Revised Code to the 157
Ohio coalition for animals, incorporated, a nonprofit corporation. 158
Except as provided in division (B) of this section, the coalition 159
shall distribute the money to its members, and the members shall 160
use the money only to pay for educational, charitable, and other 161
programs of each coalition member that provide care for unwanted, 162
abused, and neglected horses. The Ohio coalition for animals may 163
use a portion of the money to pay for reasonable marketing costs 164
incurred in the design and promotion of the license plate and for 165
administrative costs incurred in the disbursement and management 166
of funds received under this section. 167

        The registrar shall pay the contributions the registrar 168
receives pursuant to section 4503.561 of the Revised Code to the 169
state of Ohio chapter of ducks unlimited, inc., which shall 170
deposit the contributions into a special bank account that it 171
establishes. The special bank account shall be separate and 172
distinct from any other account the state of Ohio chapter of ducks 173
unlimited, inc., maintains and shall be used exclusively for the 174
purpose of protecting, enhancing, restoring, and managing wetlands 175
and conserving wildlife habitat. The state of Ohio chapter of 176
ducks unlimited, inc., annually shall notify the registrar in 177
writing of the name, address, and account to which such payments 178
are to be made. 179

        The registrar shall pay the contributions the registrar 180
receives pursuant to section 4503.562 of the Revised Code to the 181
Mahoning river consortium, which shall use the money to pay the 182
expenses it incurs in restoring and maintaining the Mahoning river 183
watershed. 184

       The registrar shall pay the contributions the registrar 185
receives pursuant to section 4503.564 of the Revised Code to 186
Antioch college for the use of the Glen Helen ecology institute to 187
pay expenses related to the Glen Helen nature preserve.188

        The registrar shall pay to a sports commission created 189
pursuant to section 4503.591 of the Revised Code each contribution 190
the registrar receives under that section that an applicant pays 191
to obtain license plates that bear the logo of a professional 192
sports team located in the county of that sports commission and 193
that is participating in the license plate program pursuant to 194
division (E) of that section, irrespective of the county of 195
residence of an applicant. 196

        The registrar shall pay to a community charity each 197
contribution the registrar receives under section 4503.591 of the 198
Revised Code that an applicant pays to obtain license plates that 199
bear the logo of a professional sports team that is participating 200
in the license plate program pursuant to division (G) of that 201
section. 202

        The registrar shall pay the contributions the registrar 203
receives pursuant to section 4503.67 of the Revised Code to the 204
Dan Beard council of the boy scouts of America. The council shall 205
distribute all contributions in an equitable manner throughout the 206
state to regional councils of the boy scouts. 207

        The registrar shall pay the contributions the registrar 208
receives pursuant to section 4503.68 of the Revised Code to the 209
great river council of the girl scouts of the United States of 210
America. The council shall distribute all contributions in an 211
equitable manner throughout the state to regional councils of the 212
girl scouts. 213

        The registrar shall pay the contributions the registrar 214
receives pursuant to section 4503.69 of the Revised Code to the 215
Dan Beard council of the boy scouts of America. The council shall 216
distribute all contributions in an equitable manner throughout the 217
state to regional councils of the boy scouts. 218

       The registrar shall pay the contributions the registrar 219
receives pursuant to section 4503.701 of the Revised Code to the 220
Prince Hall grand lodge of free and accepted masons of Ohio, which 221
shall use the contributions for scholarship purposes.222

        The registrar shall pay the contributions the registrar 223
receives pursuant to section 4503.71 of the Revised Code to the 224
fraternal order of police of Ohio, incorporated, which shall 225
deposit the fees into its general account to be used for purposes 226
of the fraternal order of police of Ohio, incorporated. 227

        The registrar shall pay the contributions the registrar 228
receives pursuant to section 4503.711 of the Revised Code to the 229
fraternal order of police of Ohio, incorporated, which shall 230
deposit the contributions into an account that it creates to be 231
used for the purpose of advancing and protecting the law 232
enforcement profession, promoting improved law enforcement 233
methods, and teaching respect for law and order. 234

       The registrar shall pay the contributions received pursuant 235
to section 4503.712 of the Revised Code to Ohio concerns of police 236
survivors, which shall use those contributions to provide whatever 237
assistance may be appropriate to the families of Ohio law 238
enforcement officers who are killed in the line of duty. 239

       The registrar shall pay the contributions received pursuant 240
to section 4503.713 of the Revised Code to the greater Cleveland 241
peace officers memorial society, which shall use those 242
contributions to honor law enforcement officers who have died in 243
the line of duty and support its charitable purposes.244

       The registrar shall pay the contributions the registrar 245
receives pursuant to section 4503.72 of the Revised Code to the 246
organization known on March 31, 2003, as the Ohio CASA/GAL 247
association, a private, nonprofit corporation organized under 248
Chapter 1702. of the Revised Code. The Ohio CASA/GAL association 249
shall use these contributions to pay the expenses it incurs in 250
administering a program to secure the proper representation in the 251
courts of this state of abused, neglected, and dependent children, 252
and for the training and supervision of persons participating in 253
that program. 254

        The registrar shall pay the contributions the registrar 255
receives pursuant to section 4503.73 of the Revised Code to Wright 256
B. Flyer, incorporated, which shall deposit the contributions into 257
its general account to be used for purposes of Wright B. Flyer, 258
incorporated. 259

       The registrar shall pay the contributions the registrar 260
receives pursuant to section 4503.732 of the Revised Code to the 261
Siegel & Shuster society, a nonprofit organization dedicated to 262
commemorating and celebrating the creation of Superman in 263
Cleveland, Ohio.264

       The registrar shall pay the contributions the registrar 265
receives pursuant to section 4503.74 of the Revised Code to the 266
Columbus zoological park association, which shall disburse the 267
moneys to Ohio's major metropolitan zoos, as defined in section 268
4503.74 of the Revised Code, in accordance with a written 269
agreement entered into by the major metropolitan zoos. 270

       The registrar shall pay the contributions the registrar 271
receives pursuant to section 4503.75 of the Revised Code to the 272
rotary foundation, located on March 31, 2003, in Evanston, 273
Illinois, to be placed in a fund known as the permanent fund and 274
used to endow educational and humanitarian programs of the rotary 275
foundation. 276

       The registrar shall pay the contributions the registrar 277
receives pursuant to section 4503.751 of the Revised Code to the 278
Ohio association of realtors, which shall deposit the 279
contributions into a property disaster relief fund maintained 280
under the Ohio realtors charitable and education foundation.281

        The registrar shall pay the contributions the registrar 282
receives pursuant to section 4503.85 of the Revised Code to the 283
Ohio sea grant college program to be used for Lake Erie area 284
research projects. 285

       The registrar shall pay the contributions the registrar 286
receives pursuant to section 4503.89 of the Revised Code to the 287
American red cross of greater Columbus on behalf of the Ohio 288
chapters of the American red cross, which shall use the 289
contributions for disaster readiness, preparedness, and response 290
programs on a statewide basis.291

       The registrar shall pay the contributions the registrar 292
receives pursuant to section 4503.90 of the Revised Code to the 293
nationwide children's hospital foundation.294

       The registrar shall pay the contributions received pursuant 295
to section 4503.92 of the Revised Code to support our troops, 296
incorporated, a national nonprofit corporation, which shall use 297
those contributions in accordance with its articles of 298
incorporation and for the benefit of servicemembers of the armed 299
forces of the United States and their families when they are in 300
financial need. 301

       The registrar shall pay the contributions the registrar 302
receives pursuant to section 4503.94 of the Revised Code to the 303
Michelle's leading star foundation, which shall use the money 304
solely to fund the rental, lease, or purchase of the simulated 305
driving curriculum of the Michelle's leading star foundation by 306
boards of education of city, exempted village, local, and joint 307
vocational school districts.308

       (C) All investment earnings of the license plate contribution 309
fund shall be credited to the fund. Not later than the first day 310
of May of every year, the registrar shall distribute to each 311
entity described in division (B) of this section the investment 312
income the fund earned the previous calendar year. The amount of 313
such a distribution paid to an entity shall be proportionate to 314
the amount of money the entity received from the fund during the 315
previous calendar year.316

       Sec. 4503.495.  (A) The owner or lessee of any passenger car, 317
noncommercial motor vehicle, recreational vehicle, or other 318
vehicle of a class approved by the registrar of motor vehicles may 319
apply to the registrar for the registration of the vehicle and 320
issuance of diabetes awareness license plates. An application made 321
under this section may be combined with a request for a special 322
reserved license plate under section 4503.40 or 4503.42 of the 323
Revised Code. Upon receipt of the completed application and 324
compliance by the applicant with divisions (B) and (C) of this 325
section, the registrar shall issue to the applicant the 326
appropriate vehicle registration and a set of diabetes awareness 327
license plates and a validation sticker, or a validation sticker 328
alone when required by section 4503.191 of the Revised Code. 329

       In addition to the letters and numbers ordinarily inscribed 330
on the license plates, diabetes awareness license plates shall be 331
inscribed with identifying words or markings that are designed by 332
the American diabetes association and approved by the registrar. 333
Diabetes awareness license plates shall display county 334
identification stickers that identify the county of registration 335
by name or number. 336

       (B) Diabetes awareness license plates and a validation 337
sticker, or validation sticker alone, shall be issued upon receipt 338
of a contribution as provided in division (C) of this section and 339
upon payment of the regular license tax as prescribed under 340
section 4503.04, any applicable motor vehicle license tax levied 341
under Chapter 4504. of the Revised Code, any applicable additional 342
fee prescribed by section 4503.40 or 4503.42 of the Revised Code, 343
a bureau of motor vehicles administrative fee of ten dollars, and 344
compliance with all other applicable laws relating to the 345
registration of motor vehicles. 346

       (C) For each application for registration and registration 347
renewal notice the registrar receives under this section, the 348
registrar shall collect a contribution of twenty-five dollars. The 349
registrar shall transmit this contribution to the treasurer of 350
state for deposit in the license plate contribution fund created 351
in section 4501.21 of the Revised Code.352

       The registrar shall transmit the administrative fee of ten 353
dollars, the purpose of which is to compensate the bureau for the 354
additional services required in the issuing of diabetes awareness 355
license plates, to the treasurer of state for deposit into the 356
state treasury to the credit of the state bureau of motor vehicles 357
fund created by section 4501.25 of the Revised Code. 358

       Section 2.  That existing section 4501.21 of the Revised Code 359
is hereby repealed.360
