BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:
Section 1. That section 1533.12 of the Revised Code be | 4 |
amended to read as follows: | 5 |
Sec. 1533.12. (A)(1) Except as otherwise provided in | 6 |
division (A)(2) of this section, every person on active duty in | 7 |
the armed forces of the United States who is stationed in this | 8 |
state and who wishes to engage in an activity for which a license, | 9 |
permit, or stamp is required under this chapter first shall obtain | 10 |
the requisite license, permit, or stamp. Such a person is eligible | 11 |
to obtain a resident hunting or fishing license regardless of | 12 |
whether the person qualifies as a resident of this state. To | 13 |
obtain a resident hunting or fishing license, the person shall | 14 |
present a card or other evidence identifying the person as being | 15 |
on active duty in the armed forces of the United States and as | 16 |
being stationed in this state. | 17 |
(2) Every person on active duty in the armed forces of the | 18 |
United States, while on leave or furlough, may take or catch fish | 19 |
of the kind lawfully permitted to be taken or caught within the | 20 |
state, may hunt any wild bird or wild quadruped lawfully permitted | 21 |
to be hunted within the state, and may trap fur-bearing animals | 22 |
lawfully permitted to be trapped within the state, without | 23 |
procuring a fishing license, a hunting license, a fur taker | 24 |
permit, or a wetlands habitat stamp required by this chapter, | 25 |
provided that the person shall carry on the person when fishing, | 26 |
hunting, or trapping, a card or other evidence identifying the | 27 |
person as being on active duty in the armed forces of the United | 28 |
States, and provided that the person is not otherwise violating | 29 |
any of the hunting, fishing, and trapping laws of this state. | 30 |
In order to hunt deer or wild turkey, any such person shall | 31 |
obtain a deer or wild turkey permit, as applicable, under section | 32 |
1533.11 of the Revised Code. However, the person need not obtain a | 33 |
hunting license in order to obtain such a permit. | 34 |
(B) The chief of the division of wildlife shall provide by | 35 |
rule adopted under section 1531.10 of the Revised Code all of the | 36 |
following: | 37 |
(1) Every resident of this state | 38 |

discharge from the armed forces of the United States | 42 |

be issued a fishing license, hunting license, fur taker permit, | 45 |
deer or wild turkey permit, or wetlands habitat stamp, or any | 46 |
combination of those licenses, permits, and stamp, free of charge | 47 |
on an annual, multi-year, or lifetime basis as determined | 48 |
appropriate by the chief when application is made to the chief in | 49 |
the manner prescribed by and on forms provided by the chief. | 50 |
(2) Every resident of the state who was born on or before | 51 |
December 31, 1937, shall be issued an annual fishing license, | 52 |
hunting license, fur taker permit, deer or wild turkey permit, or | 53 |
wetlands habitat stamp, or any combination of those licenses, | 54 |
permits, and stamp, free of charge when application is made to the | 55 |
chief in the manner prescribed by and on forms provided by the | 56 |
chief. | 57 |
(3) Every resident of state or county institutions, | 58 |
charitable institutions, and military homes in this state shall be | 59 |
issued an annual fishing license free of charge when application | 60 |
is made to the chief in the manner prescribed by and on forms | 61 |
provided by the chief. | 62 |
(4) Any mobility impaired or blind person, as defined in | 63 |
section 955.011 of the Revised Code, who is a resident of this | 64 |
state and who is unable to engage in fishing without the | 65 |
assistance of another person shall be issued an annual fishing | 66 |
license free of charge when application is made to the chief in | 67 |
the manner prescribed by and on forms provided by the chief. The | 68 |
person who is assisting the mobility impaired or blind person may | 69 |
assist in taking or catching fish of the kind permitted to be | 70 |
taken or caught without procuring the license required under | 71 |
section 1533.32 of the Revised Code, provided that only one line | 72 |
is used by both persons. | 73 |

(C) The chief shall adopt rules pursuant to section 1531.08 | 87 |
of the Revised Code designating not more than two days, which need | 88 |
not be consecutive, in each year as "free sport fishing days" on | 89 |
which any resident may exercise the privileges accorded the holder | 90 |
of a fishing license issued under section 1533.32 of the Revised | 91 |
Code without procuring such a license, provided that the person is | 92 |
not otherwise violating any of the fishing laws of this state. | 93 |
Section 2. That existing section 1533.12 of the Revised Code | 94 |
is hereby repealed. | 95 |
