BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:
Section 1. That sections 121.02 and 121.03 be amended and | 4 |
section 121.77 of the Revised Code be enacted to read as follows: | 5 |
Sec. 121.02. The following administrative departments and | 6 |
their respective directors are hereby created: | 7 |
(A) The office of budget and management, which shall be | 8 |
administered by the director of budget and management; | 9 |
(B) The department of commerce, which shall be administered | 10 |
by the director of commerce; | 11 |
(C) The department of administrative services, which shall be | 12 |
administered by the director of administrative services; | 13 |
(D) The department of transportation, which shall be | 14 |
administered by the director of transportation; | 15 |
(E) The department of agriculture, which shall be | 16 |
administered by the director of agriculture; | 17 |
(F) The department of natural resources, which shall be | 18 |
administered by the director of natural resources; | 19 |
(G) The department of health, which shall be administered by | 20 |
the director of health; | 21 |
(H) The department of job and family services, which shall be | 22 |
administered by the director of job and family services; | 23 |
(I) Until July 1, 1997, the department of liquor control, | 24 |
which shall be administered by the director of liquor control; | 25 |
(J) The department of public safety, which shall be | 26 |
administered by the director of public safety; | 27 |
(K) The department of mental health and addiction services, | 28 |
which shall be administered by the director of mental health and | 29 |
addiction services; | 30 |
(L) The department of developmental disabilities, which shall | 31 |
be administered by the director of developmental disabilities; | 32 |
(M) The department of insurance, which shall be administered | 33 |
by the superintendent of insurance as director thereof; | 34 |
(N) The development services agency, which shall be | 35 |
administered by the director of development services; | 36 |
(O) The department of youth services, which shall be | 37 |
administered by the director of youth services; | 38 |
(P) The department of rehabilitation and correction, which | 39 |
shall be administered by the director of rehabilitation and | 40 |
correction; | 41 |
(Q) The environmental protection agency, which shall be | 42 |
administered by the director of environmental protection; | 43 |
(R) The department of aging, which shall be administered by | 44 |
the director of aging; | 45 |
(S) The department of veterans services, which shall be | 46 |
administered by the director of veterans services; | 47 |
(T) The department of medicaid, which shall be administered | 48 |
by the medicaid director; | 49 |
(U) The department of grants and philanthropic gestures, | 50 |
which shall be administered by the director of grants and | 51 |
philanthropic gestures. | 52 |
The director of each department shall exercise the powers and | 53 |
perform the duties vested by law in such department. | 54 |
Sec. 121.03. The following administrative department heads | 55 |
shall be appointed by the governor, with the advice and consent of | 56 |
the senate, and shall hold their offices during the term of the | 57 |
appointing governor, and are subject to removal at the pleasure of | 58 |
the governor. | 59 |
(A) The director of budget and management; | 60 |
(B) The director of commerce; | 61 |
(C) The director of transportation; | 62 |
(D) The director of agriculture; | 63 |
(E) The director of job and family services; | 64 |
(F) Until July 1, 1997, the director of liquor control; | 65 |
(G) The director of public safety; | 66 |
(H) The superintendent of insurance; | 67 |
(I) The director of development services; | 68 |
(J) The tax commissioner; | 69 |
(K) The director of administrative services; | 70 |
(L) The director of natural resources; | 71 |
(M) The director of mental health and addiction services; | 72 |
(N) The director of developmental disabilities; | 73 |
(O) The director of health; | 74 |
(P) The director of youth services; | 75 |
(Q) The director of rehabilitation and correction; | 76 |
(R) The director of environmental protection; | 77 |
(S) The director of aging; | 78 |
(T) The administrator of workers' compensation who meets the | 79 |
qualifications required under division (A) of section 4121.121 of | 80 |
the Revised Code; | 81 |
(U) The director of veterans services who meets the | 82 |
qualifications required under section 5902.01 of the Revised Code; | 83 |
(V) The chancellor of the Ohio board of regents; | 84 |
(W) The medicaid director; | 85 |
(X) The director of grants and philanthropic gestures. | 86 |
Sec. 121.77. (A) The department of grants and philanthropic | 87 |
gestures shall do all of the following: | 88 |
(1) Assemble information, and serve as a clearinghouse making | 89 |
information available to the public, regarding each grant, and the | 90 |
criteria for applying to receive each grant, that may be available | 91 |
from this state and from the federal government, and all sources | 92 |
of private, philanthropic assistance, financial or otherwise, that | 93 |
are available to residents of this state; | 94 |
(2) Solicit private donations to provide grants and | 95 |
assistance, financial or otherwise, for economic development, | 96 |
health, safety, and morals; and | 97 |
(3) Identify barriers to, and suggest ways of removing | 98 |
barriers to, entry into business, including entry into foreign | 99 |
markets, for residents of this state. | 100 |
(B) If a grant or assistance is based on a private donation | 101 |
solicited by the department, the department shall ensure that the | 102 |
grant or assistance is provided in cooperation with the donor, and | 103 |
that any instructions the donor may have given with regard to the | 104 |
donation are complied with. | 105 |
(C) The department may receive and accept gifts, grants, | 106 |
donations, and similar funds from any lawful source to be used for | 107 |
the purposes of this section. The funds shall be deposited in the | 108 |
state treasury to the credit of the department of grants and | 109 |
philanthropic gestures gifts and grants fund, which is hereby | 110 |
created. | 111 |
(D) The department may contract with, retain the services of, | 112 |
or designate, and fix the compensation of, consultants, advisers, | 113 |
and other independent contractors as may be necessary or desirable | 114 |
to carry out this section. The director shall create a registry of | 115 |
these consultants, advisers, and other independent contractors, | 116 |
and shall make the registry available to the public. | 117 |
Section 2. That existing sections 121.02 and 121.03 of the | 118 |
Revised Code are hereby repealed. | 119 |
