A BILL

To amend section 5164.01 and to enact section 5164.09

of the Revised Code regarding Medicaid coverage of

dental services for the eligibility expansion

3

group authorized by the Patient Protection and

4

Affordable Care Act.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

Section 1. That section 5164.01 be amended and section	6
5164.09 of the Revised Code be enacted to read as follows:	7

Sec. 5164.01.  As used in this chapter:

(A) "Dental services" has the same meaning as in 42 C.F.R.	9
440.100.	10

(B) "Early and periodic screening, diagnostic, and treatment	11
services" has the same meaning as in the "Social Security Act,"	12
section 1905(r), 42 U.S.C. 1396d(r).	13

(B)(C) "Federal financial participation" has the same meaning	14
as in section 5160.01 of the Revised Code.	15

(C)(D) "Healthcheck" means the component of the medicaid	16
program that provides early and periodic screening, diagnostic,	17
and treatment services.	18

(D)(E) "Home and community-based services medicaid waiver	19
component" has the same meaning as in section 5166.01 of the	20
Revised Code.	21

(E)(F) "Hospital" has the same meaning as in section 3727.01	22
of the Revised Code.	23

(F)(G) "ICDS participant" means a dual eligible individual	24
who participates in the integrated care delivery system.	25

(G)(H) "ICF/IID" has the same meaning as in section 5124.01	26
of the Revised Code.	27

(H)(I) "Integrated care delivery system" and "ICDS" mean the	28
demonstration project authorized by section 5164.91 of the Revised	29
Code.	30

(I)(J) "Mandatory services" means the health care services	31
and items that must be covered by the medicaid state plan as a	32
condition of the state receiving federal financial participation	33
for the medicaid program.	34

(J)(K) "Medicaid managed care organization" has the same	35
meaning as in section 5167.01 of the Revised Code.	36

(K)(L) "Medicaid provider" means a person or government	37
entity with a valid provider agreement to provide medicaid	38
services to medicaid recipients. To the extent appropriate in the	39
context, "medicaid provider" includes a person or government	40
entity applying for a provider agreement, a former medicaid	41
provider, or both.	42

(L)(M) "Medicaid services" means either or both of the	43
following:	44

(1) Mandatory services;

(2) Optional services that the medicaid program covers.

(M)(N) "Nursing facility" has the same meaning as in section	47
5165.01 of the Revised Code.	48

(N)(O) "Optional services" means the health care services and	49
items that may be covered by the medicaid state plan or a federal	50
medicaid waiver and for which the medicaid program receives	51
federal financial participation.	52

(O)(P) "Prescribed drug" has the same meaning as in 42 C.F.R.	53
440.120.	54

(P)(Q) "Provider agreement" means an agreement to which all	55
of the following apply:	56

(1) It is between a medicaid provider and the department of	57
medicaid;	58

(2) It provides for the medicaid provider to provide medicaid	59
services to medicaid recipients;	60

(3) It complies with 42 C.F.R. 431.107(b).

(Q)(R) "Terminal distributor of dangerous drugs" has the same	62
meaning as in section 4729.01 of the Revised Code.	63

Sec. 5164.09.  Benchmark coverage and benchmark equivalent	64
coverage provided to the group described in the "Social Security	65
Act," section 1902(a)(10)(A)(i)(VIII), 42 U.S.C.	66
1396a(a)(10)(A)(i)(VIII), shall include dental services.	67

Section 2.  That existing section 5164.01 of the Revised Code	68
is hereby repealed.	69
