A BILL
To enact section 3109.054 of the Revised Code to 1
require railroads to allow a conductor or engineer 2
to exercise court-ordered parenting time without 3
terminating employment, reducing pay, or taking 4
other similar action against the parent. 5


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 3109.054 of the Revised Code be 6
enacted to read as follows: 7

       Sec. 3109.054.  (A) A parent who is employed by a railroad as 8
a conductor or engineer and who is granted parenting time pursuant 9
to an order issued under Title XXI or XXXI of the Revised Code or 10
by a court of competent jurisdiction of any other state may 11
provide the parent's employer with a copy of the schedule of 12
parenting time created pursuant to that order if parenting time 13
coincides with the parent's regularly scheduled hours of 14
employment. Upon receipt of the schedule, the employer shall allow 15
the parent to exercise parenting time according to the schedule 16
and shall not terminate the parent's employment, reduce the 17
parent's pay, or take any other similar adverse action against the 18
parent for exercising the parenting time.19

       (B) If a collective bargaining agreement binding on the 20
parent and the employer includes a provision governing parenting 21
time that conflicts with division (A) of this section, the 22
provision of the collective bargaining agreement shall prevail.23
