BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:
| Section 1. That section 124.395 of the Revised Code be | 5 |
| enacted to read as follows: | 6 |
| Sec. 124.395. (A) As used in this section, "state agency" has | 7 |
| the meaning defined in section 1.60 of the Revised Code. | 8 |
| (B) On and after the effective date of this section, until a | 9 |
| ten per cent reduction in the workforce of all state agencies | 10 |
| combined is attained, and notwithstanding other sections of the | 11 |
| Revised Code to the contrary, all vacancies and newly created | 12 |
| positions within a state agency shall be filled in the following | 13 |
| manner: | 14 |
| (1) Existing employees from within the state agency shall | 15 |
| first be considered to fill newly created positions or positions | 16 |
| created by retirement, death, removal, or other discontinuation of | 17 |
| employment. | 18 |
| (2) Existing employees from other state agencies may be | 19 |
| considered after those employees specified in division (B)(1) of | 20 |
| this section have been considered and no satisfactory filler or | 21 |
| replacement was found within the state agency. | 22 |
| (3) If a position cannot be filled by employees specified in | 23 |
| division (B)(1) or (2) of this section, and the appointing | 24 |
| authority concludes it is necessary to fill the position from | 25 |
| outside the existing state workforce, the appointing authority | 26 |
| shall seek written authorization from the governor. The governor | 27 |
| shall file any such written authorization with the state agency | 28 |
| and the department of administrative services before such a person | 29 |
| is hired by the agency. | 30 |
| (4) If the appointing authority of a state agency concludes | 31 |
| it is necessary to create a new position in order to fulfill the | 32 |
| work demands of the agency, the appointing authority shall seek | 33 |
| written authorization from the governor. The governor shall file | 34 |
| any such written authorization with the state agency and the | 35 |
| department of administrative services before such a new position | 36 |
| is created by the agency. | 37 |
| (C) The director of administrative services shall issue a | 38 |
| quarterly report to the speaker of the house of representatives, | 39 |
| the president of the senate, and the governor indicating the | 40 |
| progress of state agencies toward reaching a ten per cent | 41 |
| reduction in the state workforce. | 42 |
| (D) When a ten per cent reduction in the state workforce is | 43 |
| attained, as indicated by the figures maintained by the department | 44 |
| of administrative services and reported to the speaker of the | 45 |
| house of representatives, the president of the senate, and the | 46 |
| governor, the requirements of this section cease to apply. | 47 |
