A BILL
To enact section 153.014 of the Revised Code to 1
require a building or structure constructed using 2
state capital budget moneys to adhere to certain 3
energy efficiency and building standards and to 4
encourage the use of Ohio-produced products. 5


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 153.014 of the Revised Code be 6
enacted to read as follows: 7

       Sec. 153.014. (A) Any building or structure constructed using 8
any state capital budget moneys, including moneys from the 9
education facilities trust fund, shall meet both of the following:10

       (1) Achieve at least one of the following building standards:11

       (a) Certification at the silver level or higher from the 12
leadership in energy and environmental design (LEED) green 13
building rating system developed by the U.S. green building 14
council;15

       (b) Certification at the two green globes level or higher 16
from the green globes environmental assessment and rating system 17
owned and operated in the United States by the green building 18
initiative;19

       (c) A design standard determined by the director of 20
administrative services to be a nationally recognized green 21
building rating standard equivalent to the standards listed in 22
divisions (A)(1)(a) and (b) of this section.23

       (2) Achieve at least one of the following energy efficiency 24
standards:25

       (a) Exceed by at least thirty per cent the most current 26
energy efficiency standards developed by the American society of 27
heating, refrigeration, and air conditioning engineers (ASHRAE);28

       (b) Achieve a national energy performance rating of not less 29
than seventy-seven using the energy star rating system developed 30
by the United States environmental protection agency as validated 31
by a professional engineer.32

       (B) With respect to the award of any contract for 33
construction of a building or structure using any state capital 34
budget moneys, including moneys from the education facilities 35
trust fund, reasonable efforts shall be made to use Ohio products 36
and materials and to recoup the costs of implementing the 37
requirements of this section over a period of not more than twenty 38
years as measured by reduced energy costs. 39

       (C) The following construction projects are exempt from the 40
requirements of this section:41

       (1) A building or structure that is less than five thousand 42
square feet;43

       (2) A building or structure that does not consume energy for 44
heating, ventilating, or air conditioning;45

       (3) A building or structure that has construction costs less 46
than five hundred thousand dollars.47

       (D) The state agency, entity, or person overseeing the 48
erection or construction of a building or structure using state 49
capital moneys, including moneys from the education facilities 50
trust fund, that total ten per cent or less of the total 51
construction project costs may request a waiver from the 52
requirements established in divisions (A) and (B) of this section.53

       (E) Except as otherwise provided by law, each state agency, 54
entity, or person overseeing the erection or construction of a 55
building or structure using any state capital budget moneys, 56
including moneys from the education facilities trust fund, shall 57
oversee compliance with this section.58

       (F) The director of administrative services may adopt rules 59
establishing the following:60

       (1) Waiver requirements and procedures pertaining to this 61
section;62

       (2) A process and criteria for recognizing green building 63
rating standards equivalent to the standards listed in divisions 64
(A)(1)(a) and (b) of this section, as required by division 65
(A)(1)(c) of this section.66
