A BILL
To amend section 4501.21 and to enact sections 1
3301.81 and 4503.90 of the Revised Code to create 2
a "Support School Choice" license plate.3


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1.  That section 4501.21 be amended and sections 4
3301.81 and 4503.90 of the Revised Code be enacted to read as 5
follows:6

       Sec. 3301.81.  The department of education shall maintain in 7
a prominent location on the department's web site or by a 8
prominent internet link displayed on the department's web site, 9
information on various school options and opportunities including 10
programs for students with disabilities, community schools, 11
private schools, home schooling, scholarship programs, gifted 12
education, joint vocational schools, and open and post-secondary 13
enrollment. The information shall be current and conveyed in 14
language that is easy to understand.15

       The department shall cooperate with the bureau of motor 16
vehicles in establishing an internet address for use on the 17
"support school choice" license plate created in section 4503.90 18
of the Revised Code that links to the web site with school choice 19
information. The internet address shall have sixteen or fewer 20
total characters and shall be as simple, straightforward, and as 21
easy to recall as possible.22

       Sec. 4501.21.  (A) There is hereby created in the state 23
treasury the license plate contribution fund. The fund shall 24
consist of all contributions paid by motor vehicle registrants and 25
collected by the registrar of motor vehicles pursuant to sections 26
4503.491, 4503.493, 4503.494, 4503.496, 4503.498, 4503.499, 27
4503.50, 4503.501, 4503.502, 4503.505, 4503.51, 4503.522, 28
4503.523, 4503.531, 4503.545, 4503.55, 4503.551, 4503.552, 29
4503.553, 4503.561, 4503.562, 4503.564, 4503.591, 4503.67, 30
4503.68, 4503.69, 4503.701, 4503.71, 4503.711, 4503.712, 4503.713, 31
4503.72, 4503.73, 4503.74, 4503.75, 4503.751, 4503.85, 4503.89, 32
4503.92, and 4503.94 of the Revised Code. 33

       (B) The registrar shall pay the contributions the registrar 34
collects in the fund as follows: 35

        The registrar shall pay the contributions received pursuant 36
to section 4503.491 of the Revised Code to the breast cancer fund 37
of Ohio, which shall use that money only to pay for programs that 38
provide assistance and education to Ohio breast cancer patients 39
and that improve access for such patients to quality health care 40
and clinical trials and shall not use any of the money for 41
abortion information, counseling, services, or other 42
abortion-related activities. 43

        The registrar shall pay the contributions received pursuant 44
to section 4503.493 of the Revised Code to the autism society of 45
Ohio, which shall use the contributions for programs and autism 46
awareness efforts throughout the state. 47

       The registrar shall pay the contributions the registrar 48
receives pursuant to section 4503.494 of the Revised Code to the 49
national multiple sclerosis society for distribution in equal 50
amounts to the northwestern Ohio, Ohio buckeye, and Ohio valley 51
chapters of the national multiple sclerosis society. These 52
chapters shall use the money they receive under this section to 53
assist in paying the expenses they incur in providing services 54
directly to their clients.55

       The registrar shall pay the contributions the registrar 56
receives pursuant to section 4503.496 of the Revised Code to the 57
Ohio sickle cell and health association, which shall use the 58
contributions to help support educational, clinical, and social 59
support services for adults who have sickle cell disease.60

       The registrar shall pay the contributions the registrar 61
receives pursuant to section 4503.498 of the Revised Code to 62
special olympics Ohio, inc., which shall use the contributions for 63
its programs, charitable efforts, and other activities. 64

       The registrar shall pay the contributions the registrar 65
receives pursuant to section 4503.499 of the Revised Code to the 66
children's glioma cancer foundation, which shall use the 67
contributions for its research and other programs. 68

        The registrar shall pay the contributions the registrar 69
receives pursuant to section 4503.50 of the Revised Code to the 70
future farmers of America foundation, which shall deposit the 71
contributions into its general account to be used for educational 72
and scholarship purposes of the future farmers of America 73
foundation. 74

        The registrar shall pay the contributions the registrar 75
receives pursuant to section 4503.501 of the Revised Code to the 76
4-H youth development program of the Ohio state university 77
extension program, which shall use those contributions to pay the 78
expenses it incurs in conducting its educational activities. 79

        The registrar shall pay the contributions received pursuant 80
to section 4503.502 of the Revised Code to the Ohio cattlemen's 81
foundation, which shall use those contributions for scholarships 82
and other educational activities. 83

       The registrar shall pay the contributions received pursuant 84
to section 4503.505 of the Revised Code to the organization Ohio 85
region phi theta kappa, which shall use those contributions for 86
scholarships for students who are members of that organization. 87

        The registrar shall pay each contribution the registrar 88
receives pursuant to section 4503.51 of the Revised Code to the 89
university or college whose name or marking or design appears on 90
collegiate license plates that are issued to a person under that 91
section. A university or college that receives contributions from 92
the fund shall deposit the contributions into its general 93
scholarship fund. 94

        The registrar shall pay the contributions the registrar 95
receives pursuant to section 4503.522 of the Revised Code to the 96
"friends of Perry's victory and international peace memorial, 97
incorporated," a nonprofit corporation organized under the laws of 98
this state, to assist that organization in paying the expenses it 99
incurs in sponsoring or holding charitable, educational, and 100
cultural events at the monument. 101

       The registrar shall pay the contributions the registrar 102
receives pursuant to section 4503.523 of the Revised Code to the 103
fairport lights foundation, which shall use the money to pay for 104
the restoration, maintenance, and preservation of the lighthouses 105
of fairport harbor. 106

       The registrar shall pay the contributions the registrar 107
receives pursuant to section 4503.531 of the Revised Code to the 108
thank you foundation, incorporated, a nonprofit corporation 109
organized under the laws of this state, to assist that 110
organization in paying for the charitable activities and programs 111
it sponsors in support of United States military personnel, 112
veterans, and their families.113

        The registrar shall pay the contributions the registrar 114
receives pursuant to section 4503.55 of the Revised Code to the 115
pro football hall of fame, which shall deposit the contributions 116
into a special bank account that it establishes and which shall be 117
separate and distinct from any other account the pro football hall 118
of fame maintains, to be used exclusively for the purpose of 119
promoting the pro football hall of fame as a travel destination. 120

        The registrar shall pay the contributions that are paid to 121
the registrar pursuant to section 4503.545 of the Revised Code to 122
the national rifle association foundation, which shall use the 123
money to pay the costs of the educational activities and programs 124
the foundation holds or sponsors in this state. 125

        The registrar shall pay to the Ohio pet fund the 126
contributions the registrar receives pursuant to section 4503.551 127
of the Revised Code and any other money from any other source, 128
including donations, gifts, and grants, that is designated by the 129
source to be paid to the Ohio pet fund. The Ohio pet fund shall 130
use the moneys it receives under this section to support programs 131
for the sterilization of dogs and cats and for educational 132
programs concerning the proper veterinary care of those animals, 133
and for expenses of the Ohio pet fund that are reasonably 134
necessary for it to obtain and maintain its tax-exempt status and 135
to perform its duties. 136

        The registrar shall pay the contributions the registrar 137
receives pursuant to section 4503.552 of the Revised Code to the 138
rock and roll hall of fame and museum, incorporated. 139

        The registrar shall pay the contributions the registrar 140
receives pursuant to section 4503.553 of the Revised Code to the 141
Ohio coalition for animals, incorporated, a nonprofit corporation. 142
Except as provided in division (B) of this section, the coalition 143
shall distribute the money to its members, and the members shall 144
use the money only to pay for educational, charitable, and other 145
programs of each coalition member that provide care for unwanted, 146
abused, and neglected horses. The Ohio coalition for animals may 147
use a portion of the money to pay for reasonable marketing costs 148
incurred in the design and promotion of the license plate and for 149
administrative costs incurred in the disbursement and management 150
of funds received under this section. 151

        The registrar shall pay the contributions the registrar 152
receives pursuant to section 4503.561 of the Revised Code to the 153
state of Ohio chapter of ducks unlimited, inc., which shall 154
deposit the contributions into a special bank account that it 155
establishes. The special bank account shall be separate and 156
distinct from any other account the state of Ohio chapter of ducks 157
unlimited, inc., maintains and shall be used exclusively for the 158
purpose of protecting, enhancing, restoring, and managing wetlands 159
and conserving wildlife habitat. The state of Ohio chapter of 160
ducks unlimited, inc., annually shall notify the registrar in 161
writing of the name, address, and account to which such payments 162
are to be made. 163

        The registrar shall pay the contributions the registrar 164
receives pursuant to section 4503.562 of the Revised Code to the 165
Mahoning river consortium, which shall use the money to pay the 166
expenses it incurs in restoring and maintaining the Mahoning river 167
watershed. 168

       The registrar shall pay the contributions the registrar 169
receives pursuant to section 4503.564 of the Revised Code to 170
Antioch college for the use of the Glen Helen ecology institute to 171
pay expenses related to the Glen Helen nature preserve.172

        The registrar shall pay to a sports commission created 173
pursuant to section 4503.591 of the Revised Code each contribution 174
the registrar receives under that section that an applicant pays 175
to obtain license plates that bear the logo of a professional 176
sports team located in the county of that sports commission and 177
that is participating in the license plate program pursuant to 178
division (E) of that section, irrespective of the county of 179
residence of an applicant. 180

        The registrar shall pay to a community charity each 181
contribution the registrar receives under section 4503.591 of the 182
Revised Code that an applicant pays to obtain license plates that 183
bear the logo of a professional sports team that is participating 184
in the license plate program pursuant to division (G) of that 185
section. 186

        The registrar shall pay the contributions the registrar 187
receives pursuant to section 4503.67 of the Revised Code to the 188
Dan Beard council of the boy scouts of America. The council shall 189
distribute all contributions in an equitable manner throughout the 190
state to regional councils of the boy scouts. 191

        The registrar shall pay the contributions the registrar 192
receives pursuant to section 4503.68 of the Revised Code to the 193
great river council of the girl scouts of the United States of 194
America. The council shall distribute all contributions in an 195
equitable manner throughout the state to regional councils of the 196
girl scouts. 197

        The registrar shall pay the contributions the registrar 198
receives pursuant to section 4503.69 of the Revised Code to the 199
Dan Beard council of the boy scouts of America. The council shall 200
distribute all contributions in an equitable manner throughout the 201
state to regional councils of the boy scouts. 202

       The registrar shall pay the contributions the registrar 203
receives pursuant to section 4503.701 of the Revised Code to the 204
Prince Hall grand lodge of free and accepted masons of Ohio, which 205
shall use the contributions for scholarship purposes.206

        The registrar shall pay the contributions the registrar 207
receives pursuant to section 4503.71 of the Revised Code to the 208
fraternal order of police of Ohio, incorporated, which shall 209
deposit the fees into its general account to be used for purposes 210
of the fraternal order of police of Ohio, incorporated. 211

        The registrar shall pay the contributions the registrar 212
receives pursuant to section 4503.711 of the Revised Code to the 213
fraternal order of police of Ohio, incorporated, which shall 214
deposit the contributions into an account that it creates to be 215
used for the purpose of advancing and protecting the law 216
enforcement profession, promoting improved law enforcement 217
methods, and teaching respect for law and order. 218

       The registrar shall pay the contributions received pursuant 219
to section 4503.712 of the Revised Code to Ohio concerns of police 220
survivors, which shall use those contributions to provide whatever 221
assistance may be appropriate to the families of Ohio law 222
enforcement officers who are killed in the line of duty. 223

       The registrar shall pay the contributions received pursuant 224
to section 4503.713 of the Revised Code to the greater Cleveland 225
peace officers memorial society, which shall use those 226
contributions to honor law enforcement officers who have died in 227
the line of duty and support its charitable purposes.228

       The registrar shall pay the contributions the registrar 229
receives pursuant to section 4503.72 of the Revised Code to the 230
organization known on March 31, 2003, as the Ohio CASA/GAL 231
association, a private, nonprofit corporation organized under 232
Chapter 1702. of the Revised Code. The Ohio CASA/GAL association 233
shall use these contributions to pay the expenses it incurs in 234
administering a program to secure the proper representation in the 235
courts of this state of abused, neglected, and dependent children, 236
and for the training and supervision of persons participating in 237
that program. 238

        The registrar shall pay the contributions the registrar 239
receives pursuant to section 4503.73 of the Revised Code to Wright 240
B. Flyer, incorporated, which shall deposit the contributions into 241
its general account to be used for purposes of Wright B. Flyer, 242
incorporated. 243

       The registrar shall pay the contributions the registrar 244
receives pursuant to section 4503.74 of the Revised Code to the 245
Columbus zoological park association, which shall disburse the 246
moneys to Ohio's major metropolitan zoos, as defined in section 247
4503.74 of the Revised Code, in accordance with a written 248
agreement entered into by the major metropolitan zoos. 249

       The registrar shall pay the contributions the registrar 250
receives pursuant to section 4503.75 of the Revised Code to the 251
rotary foundation, located on March 31, 2003, in Evanston, 252
Illinois, to be placed in a fund known as the permanent fund and 253
used to endow educational and humanitarian programs of the rotary 254
foundation. 255

       The registrar shall pay the contributions the registrar 256
receives pursuant to section 4503.751 of the Revised Code to the 257
Ohio association of realtors, which shall deposit the 258
contributions into a property disaster relief fund maintained 259
under the Ohio realtors charitable and education foundation.260

        The registrar shall pay the contributions the registrar 261
receives pursuant to section 4503.85 of the Revised Code to the 262
Ohio sea grant college program to be used for Lake Erie area 263
research projects. 264

       The registrar shall pay the contributions the registrar 265
receives pursuant to section 4503.89 of the Revised Code to the 266
American red cross of greater Columbus on behalf of the Ohio 267
chapters of the American red cross, which shall use the 268
contributions for disaster readiness, preparedness, and response 269
programs on a statewide basis.270

       The registrar shall pay the contributions the registrar 271
receives pursuant to section 4503.90 of the Revised Code to school 272
choice Ohio, a nonprofit organization, which shall use the 273
contributions for the purpose of providing information about 274
school choices in Ohio.275

       The registrar shall pay the contributions received pursuant 276
to section 4503.92 of the Revised Code to support our troops, 277
incorporated, a national nonprofit corporation, which shall use 278
those contributions in accordance with its articles of 279
incorporation and for the benefit of servicemembers of the armed 280
forces of the United States and their families when they are in 281
financial need. 282

       The registrar shall pay the contributions the registrar 283
receives pursuant to section 4503.94 of the Revised Code to the 284
Michelle's leading star foundation, which shall use the money 285
solely to fund the rental, lease, or purchase of the simulated 286
driving curriculum of the Michelle's leading star foundation by 287
boards of education of city, exempted village, local, and joint 288
vocational school districts.289

       (C) All investment earnings of the license plate contribution 290
fund shall be credited to the fund. Not later than the first day 291
of May of every year, the registrar shall distribute to each 292
entity described in division (B) of this section the investment 293
income the fund earned the previous calendar year. The amount of 294
such a distribution paid to an entity shall be proportionate to 295
the amount of money the entity received from the fund during the 296
previous calendar year. 297

       Sec. 4503.90.  (A) The owner or lessee of any passenger car, 298
noncommercial motor vehicle, recreational vehicle, or other 299
vehicle of a class approved by the registrar of motor vehicles may 300
apply to the registrar for the registration of the vehicle and 301
issuance of "support school choice" license plates. The 302
application may be combined with a request for a special reserved 303
license plate under section 4503.40 or 4503.42 of the Revised 304
Code. Upon receipt of the completed application and compliance by 305
the applicant with divisions (B) and (C) of this section, the 306
registrar shall issue to the applicant the appropriate vehicle 307
registration and a set of "support school choice" license plates 308
and a validation sticker, or a validation sticker alone when 309
required by section 4503.191 of the Revised Code.310

       In addition to the letters and numbers ordinarily inscribed 311
on the license plates, "support school choice" license plates 312
shall bear the words "support school choice." The bureau of motor 313
vehicles shall design "support school choice" license plates, 314
which also shall bear an internet address that is established in 315
cooperation with the department of education pursuant to section 316
3301.81 of the Revised Code. "Support school choice" license 317
plates shall display county identification stickers that identify 318
the county of registration by name or number.319

       (B) "Support school choice" license plates and a validation 320
sticker, or validation sticker alone, shall be issued upon receipt 321
of an application for registration of a motor vehicle under this 322
section; payment of the regular license tax as prescribed under 323
section 4503.04 of the Revised Code, any applicable motor vehicle 324
license tax levied under Chapter 4504. of the Revised Code, any 325
applicable additional fee prescribed by section 4503.40 or 4503.42 326
of the Revised Code, an additional fee of ten dollars, and a 327
contribution as provided in division (C) of this section; and 328
compliance with all other applicable laws relating to the 329
registration of motor vehicles.330

       (C) For each application for registration and registration 331
renewal notice the registrar receives under this section, the 332
registrar shall collect a contribution of twenty-five dollars. The 333
registrar shall transmit the twenty-five dollar contribution to 334
the treasurer of state for deposit into the state treasury to the 335
credit of the license plate contribution fund created by section 336
4501.21 of the Revised Code.337

       (D) The registrar shall transmit the additional fee of ten 338
dollars, which is to compensate the bureau for the additional 339
services required in the issuing of "support school choice" 340
license plates, to the treasurer of state for deposit into the 341
state treasury to the credit of the state bureau of motor vehicles 342
fund created by section 4501.25 of the Revised Code.343

       (E) Sections 4503.77 and 4503.78 of the Revised Code do not 344
apply to license plates issued under this section.345

       Section 2.  That existing section 4501.21 of the Revised Code 346
is hereby repealed.347
