BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:
Section 1. That section 2927.01 of the Revised Code be | 4 |
amended to read as follows: | 5 |
Sec. 2927.01. (A) No person, except as authorized by law, | 6 |
shall treat a human corpse in a way that the person knows would | 7 |
outrage reasonable family sensibilities. | 8 |
(B) No person, except as authorized by law, shall treat a | 9 |
human corpse in a way that would outrage reasonable community | 10 |
sensibilities. | 11 |
(C) No person shall engage in sexual conduct, as defined in | 12 |
section 2907.01 of the Revised Code, with a human corpse. | 13 |
(D) Whoever violates division (A) of this section is guilty | 14 |
of abuse of a corpse, a misdemeanor of the second degree. Whoever | 15 |
violates division (B) of this section is guilty of gross abuse of | 16 |
a corpse, a felony of the fifth degree. Whoever violates division | 17 |
(C) of this section is guilty of necrophilia, a felony of the | 18 |
third degree. | 19 |
Section 2. That existing section 2927.01 of the Revised Code | 20 |
is hereby repealed. | 21 |
