SYNOPSIS

     Urges President and Congress to enact H.R.263 of 2017, rendering United Nations Security Council Resolution 2334 (2016), concerning certain Israeli settlements, null and void as matter of U.S. law.

A Senate Resolution urging the President and Congress of the United States to enact H.R.263 of 2017, rendering United Nations Security Council Resolution 2334 (2016), concerning certain Israeli settlements, null and void as a matter of United States law.

 

Whereas, The State of Israel has been a loyal friend and strong ally to the United States since its establishment in 1948 and immediate recognition by President Harry S. Truman; and

Whereas, The United States government has historically opposed and vetoed United Nations Security Council resolutions that are one-sided and excessively or unfairly critical of Israel; and

Whereas, On December 23, 2016, the United Nations Security Council adopted Resolution 2334, which condemns Israeli settlements in the West Bank and East Jerusalem; and

Whereas, The United States government, under the direction of President Barack Obama, broke its well-established commitment to the State of Israel, the strongest ally of the United States in the Middle East, and broke with longstanding United States foreign policy by failing to veto this resolution unfairly condemning Israel; and

Whereas, On January 4, 2017, H.R.263 of 2017, the "United States Sovereignty and Commercial Freedom Act," was introduced in the United States House of Representatives; and

Whereas, Among other things, this bill declares that Resolution 2334 has no force or effect under United States law, and that the United States will not be bound by any provision of the resolution, including the differentiation provision therein, which asked member states to distinguish, in their relevant dealings, between the territory of the State of Israel and the territories occupied since 1967; and

Whereas, The bill further stated that Resolution 2334 and any subsequently adopted United Nations Security Council resolution relating to Israel may not be used to establish or demonstrate a violation of United States law or an offence against the law of nations in United States courts; and

Whereas, This House supports H.R.263 and its assertion that several statements in Resolution 2334 about the legality of Israeli civilian presence in the West Bank and East Jerusalem do not represent the policy of the United States and that those statements, if applied to United States citizens or to their rights to purchase property and reside in these territories, violate United States principles of civil rights and non-discrimination; and

Whereas, It is therefore fitting and proper for this House to urge the President and Congress of the United States to enact H.R.263 of 2017, rendering United Nations Security Council Resolution 2334 (2016) null and void as a matter of United States law; now, therefore,

     Be It Resolved by the Senate of the State of New Jersey:

 

     1.    This House urges the President and Congress of the United States to enact H.R.263 of 2017, rendering United Nations Security Council Resolution 2334, adopted December 23, 2016, null and void as a matter of United States law.

 

     2.    Copies of this resolution, as filed with the Secretary of State, shall be transmitted by the Secretary of the Senate to the President and Vice President of the United States, the Majority and Minority Leaders of the United States Senate, the Speaker and Majority and Minority Leaders of the United States House of Representatives, the United States Ambassador to the United Nations, and each member of the United States Congress elected from this State.

 

 

STATEMENT

 

     The State of Israel has been a loyal friend and strong ally to the United States since its establishment in 1948 and immediate recognition by President Harry S. Truman.  Though the United States government has historically opposed and vetoed United Nations Security Council resolutions that are excessively or unfairly critical of Israel, on December 23, 2016, the United States government, under the direction of President Barack Obama, broke its longstanding commitment to the State of Israel by failing to veto United Nations Security Council Resolution 2334, which condemns Israeli settlements in the West Bank and East Jerusalem.

     In response, on January 4, 2017, H.R.263 of 2017, the "United States Sovereignty and Commercial Freedom Act," was introduced in the United States House of Representatives declaring that Resolution 2334 has no force or effect under United States law, and that the United States will not be bound by any provision of the resolution. The bill further stated that Resolution 2334 and any subsequently adopted United Nations Security Council resolution relating to Israel may not be used to establish or demonstrate a violation of United States law or an offence against the law of nations in United States courts.
