SYNOPSIS
Proposes constitutional amendment to change Attorney General's term of office to five years.

A Concurrent Resolution proposing to amend Article V, Section IV, paragraph 3 of the New Jersey Constitution.
Be It Resolved by the Senate of the State of New Jersey (the General Assembly concurring):
1. The following proposed amendment to the Constitution of the State of New Jersey is agreed to:
PROPOSED AMENDMENT
Amend Article V, Section IV, paragraph 3 to read as follows:
3. a. The Secretary of State [and the Attorney General] shall be nominated and appointed by the Governor with the advice and consent of the Senate to serve during the term of office of the Governor, except the Governor may appoint the Lieutenant Governor to serve as Secretary of State without the advice and consent of the Senate.
b. The Attorney General shall be nominated and appointed by the Governor with the advice and consent of the Senate to serve for a term of five years. The term of office shall begin at noon on the third Tuesday in January and end at noon on the third Tuesday in January five years thereafter.

2. When this proposed amendment to the Constitution is finally agreed to pursuant to Article IX, paragraph 1 of the Constitution, it shall be submitted to the people at the next general election occurring more than three months after the final agreement and shall be published at least once in at least one newspaper of each county designated by the President of the Senate, the Speaker of the General Assembly and the Secretary of State, not less than three months prior to the general election.
3. This proposed amendment to the Constitution shall be submitted to the people at that election in the following manner and form:
There shall be printed on each official ballot to be used at the general election, the following:
a. In every municipality in which voting machines are not used, a legend which shall immediately precede the question as follows:

This amendment would extend the term of office of the Attorney General by one year. The term of office would be five years. Currently, the Attorney General is appointed by the Governor, with the advice and consent of the Senate, to serve during the Governor's term of office. With this change, the term of the Attorney General would extend into the next gubernatorial term. |
SCHEDULE
This constitutional amendment shall, if approved, take effect at noon on the third Tuesday in January following the next general election at which a Governor is elected for a full term.
STATEMENT
This proposed constitutional amendment would provide for a five year term of office for the Attorney General. Currently, the Attorney General is appointed by the Governor, with the advice and consent of the Senate, to serve during the Governor's term of office. The change to a five year term would have the Attorney General's term extend into the gubernatorial administration that follows the one during which the Attorney General was appointed.
