SYNOPSIS

     Requires NJ Sports and Exposition Authority to notify and receive input from Hackensack Meadowlands Development Commission and Hackensack Meadowlands District municipalities concerning certain Meadowlands complex projects.

An Act concerning the development of projects within the Meadowlands complex and supplementing P.L.1971, c.137 (C.5:10-1 et seq.).

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a. Notwithstanding the provisions of any law, rule, or regulation to the contrary, whenever the New Jersey Sports and Exposition Authority receives plans from a developer in response to a request for proposal for the development, improvement, or redevelopment of, or for the construction or reconstruction of, a project on lands within the Meadowlands complex which substantially change the scope, character or use of a project that was previously approved by the authority, or modifying an existing agreement or contract substantially changing the scope, character, or use of a project, the authority shall notify within seven days, in writing by certified mail, the Hackensack Meadowlands Development Commission, established under section 5 of P.L.1968, c.404 (C.13:17-5), and both the mayor or elected chief executive  and the governing body of each constituent municipality of the Hackensack Meadowlands District as defined pursuant to section 3 of P.L.1968, c.404 (C.13:17-3), of the change that is sought by the developer and shall thereafter schedule regular meetings to consult with, and seek information and input from, the commission and the mayor or elected chief executive, or a designated representative of each mayor or elected chief executive, of each constituent municipality, regarding the change in the scope, character or use of the project.

     b.    Prior to entering into or modifying any agreement or contract substantially changing the scope, character, or use of a project, the New Jersey Sports and Exposition Authority shall notify the Hackensack Meadowlands Development Commission and the municipalities located in the immediate vicinity of the subject project to allow the opportunity for input by those municipalities and by the commission on the proposed changes.  The authority shall notify within seven days, in writing by certified mail, the Hackensack Meadowlands Development Commission and both the mayor or elected chief executive and the governing body of each constituent municipality located in the immediate vicinity of the subject project, of the change that is sought by the developer.  Prior to any modification to, or entering into a contract or agreement, the authority shall schedule regular meetings to consult with, and seek information and input from, the commission and the mayor or elected chief executive, and the governing body or a designated representative of each mayor, elected chief executive, or governing body of each constituent municipality or municipalities, notified pursuant to this section, regarding the change in the scope, character, or use of the project.

     c.     The authority shall continue to schedule the meetings required by this section on a regular basis until:

     (1)   the project is completed at which time the authority shall notify the commission, and the mayor or elected chief executive of each constituent municipality, of the date of completion of the project; or

     (2)   a determination is made that no modification will be made or contract or agreement entered into.

 

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill requires the New Jersey Sports and Exposition Authority (the "authority") to send written notice by certified mail to the Hackensack Meadowlands Development Commission (the "commission"), and both the mayor or elected chief executive and the governing body of each of the constituent municipalities of the Hackensack Meadowlands District, within seven days whenever the authority receives plans in response to a request for proposal from a developer that substantially changes the scope, character, or use of a project previously approved by the authority.  Prior to adopting any modification to a previously approved project, the bill also requires the authority to notify the commission, and those municipalities in the immediate vicinity of the subject project, to allow the opportunity for input by the commission, and by the municipalities, on the proposed changes.

     The bill requires the authority to schedule meetings prior to entering into any agreements or contracts, and to consult with, and receive input from, the commission and the mayors or elected chief executives and the governing bodies of the constituent municipalities, or their designated representatives, regarding the change in the scope, character or use of the project.  The bill requires the authority to continue scheduling such meetings until: (1) a project is completed at which time notice shall be sent to the commission, and to each constituent municipality, of the date of completion of the project; or (2) a determination is made that no modification will be made or contract entered into.
