Provides bidder is ineligible to receive new State contract award if current contract is in dispute by State.

An Act concerning the eligibility of certain bidders to receive a new State contract award and supplementing chapter 34 of Title 52 of the Revised Statutes.
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. Notwithstanding any law,
rule, or regulation to the contrary, a bidder shall be ineligible to receive a
new State contract if the bidder has failed to perform the work under an
existing State contract, as determined by the State Contract Manager for the existing
contract pursuant to section 7 of P.L.2005, c.336
(C.52:34-10.7), or if the existing State contract is on hold, incomplete, or
undergoing litigation involving the bidder's performance or nonperformance of
the contract.
2. This act shall take effect immediately.
STATEMENT
This bill provides that a bidder would be ineligible to receive a new State contract award if a current contract is in dispute by the State.
Under the bill, the bidder would be ineligible to receive a new State contract if the bidder has failed to perform the required work under an existing State contract, as determined by the State Contract Manager for the existing contract, or if the existing State contract is on hold, incomplete, or undergoing litigation involving the bidder's performance or nonperformance of the contract.
The intent of this bill is to ensure that bidders for State contracts do not enter into new State projects until a dispute concerning a current State project is resolved.
