SYNOPSIS

     Requires retailers to provide food product recall notices through loyalty card programs.

An Act concerning food product recall notices and supplementing Title 24 of the Revised Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    As used in this act:

     "Food" means a food, food product, food ingredient, dietary supplement or beverage.

     "Rewards or loyalty card" means a card or certificate issued and distributed by a retail food store to a consumer pursuant to an awards, loyalty, rewards or promotional program, without payment of any money or other consideration or thing of value by the consumer in exchange for the card or certificate.

     "Retail food store" means any retail establishment that sells food including, but not limited to, a supermarket, a grocery store and a drug store.

 

     2.    A retail food store that utilizes a rewards or loyalty card program for its customers shall use the contact information provided by the customer for enrollment in that rewards or loyalty card program to promptly notify the customer of any food recall or safety alerts issued or publicized by the United States Food and Drug Administration or the manufacturer itself, if the customer used the rewards or loyalty card in the purchase of the recalled food.

 

     3.    Notification pursuant to section 2 of this act shall be mailed to the customer and shall include, at a minimum, the following information: the recalled food name and description; packaging description; lot numbers, product codes or other identifying codes; the dates the food was sold; expiration dates; and manufacturer name and contact information.  In addition, the notification shall provide instructions to return the recalled food to the retail food store or proper disposal instructions, as appropriate.

 

     4.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill would require a retail food store to utilize customer contact information provided for enrollment in its rewards or loyalty card program for purposes of promptly notifying their customers of food recalls.  Notification shall be written and mailed to the customer and include such information as the recalled food name and description, packaging information, identifying codes, the dates the food was sold, expiration dates, the manufacturer's name and contact information, and instructions for returning or disposal of the recalled food.
