     Delays implementation of P.L.2009, c.166, concerning role and qualification of local purchasing agents.

An Act concerning local purchasing agents and amending P.L.2009, c.166.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    Section 7 of P.L.2009, c.166 is amended to read as follows:

     7.    This act shall take effect on the first day of the thirteenth month next following enactment, but shall remain inoperative until the Director of the Division of Local Government Services in the Department of Community Affairs [may take] has completed [such anticipatory] administrative action in advance thereof as shall be necessary for the implementation of this act.

     2.    This act shall take effect immediately and shall be retroactive to December 17, 2009.

 

 

STATEMENT

 

     This bill would delay the implementation of P.L.2009, c.166, which concerns the role and qualifications of local purchasing agents in the "Local Public Contracts Law," P.L.1971, c.198 (C.40A:11-1 et seq.).  It has come to the attention of the sponsor of this bill that the Director of the Division of Local Government Services in the Department of Community Affairs has not yet drafted the State examination for a qualified purchasing agent required by section 3 of P.L.2009, c.166.  This bill would give the director time to draft the examination before the law becomes operative.
