SYNOPSIS
Modifies municipal Tourist Development Commission advertising disbursement requirement for advertising outside municipality.

An Act concerning revenues allocated to a municipality's Tourist Development Commission for certain advertising and amending P.L.1982, c.68.
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. Section 5 of P.L.1982, c.68 (C.40:54C-3) is amended to read as follows:
5. The commission shall have exclusive authority to disburse all revenues allocated to the fund established pursuant to section 2 of [this act] P.L.1982, c.68 (C.40:52-8). It shall spend moneys from the fund in the manner it deems advisable for the purpose of publicizing and otherwise promoting the municipality it serves in order to attract tourism; however, at least [50 percent] a minimum percentage of the revenues from the fund, as determined by the commission, shall be disbursed for advertising outside of the municipality to attract tourists into the municipality. The purpose of [this act] P.L.1982, c.68 (C.40:52-7 et al.) shall be considered a public purpose.

2. This act shall take effect immediately.
STATEMENT
This bill modifies the requirement for a portion of the revenues allocated to a municipality's Tourist Development Commission (commission) to be disbursed for advertising outside the municipality from 50 percent to a percentage to be determined by the commission. This modification accounts for the change in advertising as a result of the technological advancement which has occurred since the passage of this law. This bill permits the commission to determine what percentage of the appropriated revenue is adequate for advertising outside of the municipality. This would make funds available for tourist development which would otherwise be mandated for use in advertising under current law.
