An Act concerning certain automated teller machines and supplementing Title 17 of the Revised Statutes.
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. As used in this act:
"Automated teller machine" means an electronic information processing device located in the State which accepts or dispenses cash in connection with a credit or deposit account. The term does not include tellers' stations staffed by a person or other staffed facilities.
"Independent service organization" means any entity, other than a State or federally chartered bank, savings bank, savings and loan association, or credit union, which operates an automated teller machine in this State.
2. Every independent service organization which operates an automated teller machine shall:
a. Install and maintain a video camera which at least views and records all persons who effect a transaction at the automated teller machine; and
b. Preserve the recordings made by the video camera for at least 45 days.
3. The provisions of this act shall not apply to any automated teller machine located in any building unless:
a. The building exists solely to provide an enclosure for the automated teller machine; or
b. A user of the automated teller machine is able to conduct a transaction from outside the building.
4. An independent service organization found to be in violation of this act shall be subject to a civil penalty of not more than $1,000 per day for each day that the independent service organization is in violation of this act. The penalty may be collected by a summary proceeding instituted by the Commissioner of Banking and Insurance in accordance with the "Penalty Enforcement Law of 1999," P.L.1999, c.274 (C.2A:58-10 et seq.).
5. This act shall take effect on the 90th day after enactment.
STATEMENT
This bill requires any independent service organization which operates an automated teller machine (ATM) to install and maintain a video camera which at least views and records all persons who effect a transaction at the ATM and preserve the recordings made by the video camera for at least 45 days. An independent service organization is an entity, other than a State or federally chartered bank, savings bank, savings and loan association, or credit union, which operates an ATM in this State. This bill does not apply to any ATM located in any building unless the building exists solely to provide an enclosure for the ATM, or a user of the ATM is able to conduct a transaction from outside the building. The bill provides for enforcement by the Commissioner of Banking and Insurance and a civil penalty of up to $1,000 per day for failure to comply with the provisions of the bill.
