STATEMENT

This bill eliminates the 16 hour per 24-hour period coverage limit on private duty nursing services for certain Medicaid enrollees who are 21 years of age or older.

Under N.J.A.C.10:60-5.9, private duty nursing services are limited to a maximum of 16 hours per 24-hour period for Medicaid managed long-term support services enrollees.  This bill eliminates the 16 hours limit, and provides that an individual who is 21 years of age or older and eligible to receive private duty nursing services under the Medicaid managed long-term support services program is to be eligible to receive up to 24 hours of private duty nursing services in a 24-hour period, if the severity of the individual's illness requires such services, as determined by the Commission of Human Services.

The bill requires the Commissioner of Human Services to apply for such State plan amendments or waivers as may be necessary to implement the provisions of the bill and to secure federal financial participation for State Medicaid expenditures.
