SYNOPSIS
Increases penalties for motor vehicle violations resulting in serious bodily injury or death to certain persons in highway.

An Act concerning highway collisions resulting in injury or death and supplementing Title 39 of the Revised Statutes.
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. a. If a court determines that a violation of the provisions of Title 39 of the Revised Statutes is the proximate cause of a collision resulting in serious bodily injury or death of a pedestrian, a person using a wheelchair, motorized wheelchair, or electric personal assistive mobility device, a driver or rider of a horse, a driver or rider of a bicycle, a person operating on roller skates, a skateboard, or a motorized skateboard, or a person in an area of highway construction or repair engaged in the construction, reconstruction, repair, or maintenance of the highway, and if the person who suffered serious bodily injury or death was lawfully occupying the highway, the person convicted of a violation of Title 39 of the Revised Statutes shall, in addition to any other penalty or fine imposed by any other section of law, be:
(1) subject to a fine of $1,000 to be deposited into the "Pedestrian Safety Enforcement and Education Fund" created by section 1 of P.L.2005, c.86 (C.39:4-36.2), and
(2) required to successfully complete a remedial training course of not less than four hours which may be given by the commission, a driving school licensed by the chief administrator pursuant to section 2 of P.L.1951, c.216 (C.39:12-2), or any Statewide safety organization approved by the chief administrator.
b. For the purposes of this section:
"Area of highway construction or repair" shall have the same meaning as set forth in section 1 of P.L.1993, c.332 (C.39:4-203.5).
"Chief Administrator" means the Chief Administrator of the New Jersey Motor Vehicle Commission.
"Commission" means the New Jersey Motor Vehicle Commission.
"Electric personal assistive mobility device" shall have the same meaning as set forth in section 1 of P.L.2001, c.430 (C.39:4-14.10).
"Roller skates" shall have the same meaning as set forth in section 1 of P.L.1997, c.411 (C.39:4-10.5).
"Serious bodily injury" shall have the same meaning as set forth in subsection b. of N.J.S.2C:11-1.
2. The chief administrator, in accordance with the provisions of the "Administrative Procedure Act," P.L.1968, c.410 (C.52:14B-1 et seq.), shall promulgate rules and regulations to effectuate the purposes of this act.
3. This act shall take
effect immediately.
STATEMENT
This bill requires a person convicted of a motor vehicle violation to pay a fine of $1,000 to be deposited into the "Pedestrian Safety Enforcement and Education Fund" and successfully complete a remedial training course of not less than four hours if the court determines that the violation was the proximate cause of a collision resulting in serious bodily injury or death of a pedestrian, a person using a wheelchair, motorized wheelchair, or electric personal assistive mobility device, a driver or rider of a horse, a driver or rider of a bicycle, a person operating on roller skates, a skateboard, or a motorized skateboard, or a person in an area of highway construction or repair engaged in the construction, reconstruction, repair, or maintenance of the highway lawfully occupying the highway.
The penalties imposed by the bill are in addition to any other fine or penalty imposed by law.
