SYNOPSIS

     Requires NJTA and SJTA to establish temporary amnesty program for fees associated with outstanding unpaid tolls.

An Act establishing a temporary amnesty program for fees associated with outstanding unpaid tolls.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.  Notwithstanding the provisions of section 10 of P.L.1951, c.264 (C.27:23-34) and sections 6 through 10 of P.L.1997, c.59 (C.27:23-34.1 through C.27:23-34.5) and any other law, rule, or regulation to the contrary, the New Jersey Turnpike Authority shall provide an amnesty program for any resident of this State charged with an outstanding violation for the non-payment of tolls or a violation of the toll collection monitoring system regulations adopted pursuant to section 7 of P.L.1997, c.59 (C.27:23-34.2), as of the effective date of this act.

     b.    The amnesty program created pursuant to subsection a. of this section shall allow for any resident of this State charged with an outstanding violation for the non-payment of tolls or a violation of the toll collection monitoring system regulations adopted pursuant to section 7 of P.L.1997, c.59 (C.27:23-34.2), as of the effective date of this act, to pay the outstanding tolls in full, within 180 days from the effective date of this act, in exchange for having the following fees related to the toll violation waived: (1) any administrative fee assessed for the processing and collecting a violation pursuant to section 8 of P.L.1997, c.59 (C.27:23-34.3); or (2) accrued late fees.

     In the event that a toll amount cannot be determined by the authority, the authority may charge the maximum toll rate for the roadway on which the toll violation occurred.

     c. The authority shall publish on every publicly accessible webpage of the website in which the authority provides information concerning the purchase of an electronic vehicle identification system transponder or the initiation of an account with a New Jersey electronic toll collection system, subject to sections 6 through 10 of P.L.1997, c.59 (C.27:23-34.1 through C.27:23-34.5), and on the account statement of any New Jersey resident who is a customer that has an account with a New Jersey electronic toll collection system, subject to sections 6 through 10 of P.L.1997, c.59 (C.27:23-34.1 through C.27:23-34.5), information concerning the amnesty program and the waiver of administrative fees and accrued late fees for a period of 180 days from the effective date of this act.

 

     2.    a.  Notwithstanding the provisions of section 21 of P.L.1991, c.252 (C.27:25A-21) and sections 11 through 15 of P.L.1997, c.59 (C.27:25A-21.1 through C.27:25A-21.5) and any other law, rule, or regulation to the contrary, the South Jersey Transportation Authority shall provide an amnesty program for any resident of this State charged with an outstanding violation for the non-payment of tolls or a violation of the toll collection monitoring system regulations adopted pursuant to section 12 of P.L.1997, c.59 (C.27:25A-21.2), as of the effective date of this act.

     b.    The amnesty program created pursuant to subsection a. of this section shall allow for any resident of this State charged with an outstanding violation for the non-payment of tolls or a violation of the toll collection monitoring system regulations adopted pursuant to section 12 of P.L.1997, c.59 (C.27:25A-21.2) to pay the outstanding tolls in full, within 180 days from the effective date of this act, in exchange for having the following fees related to the toll violation waived: (1) any administrative fee assessed for the processing and collecting a violation pursuant to section 13 of P.L.1997, c.59 (C.27:25A-21.3); or (2) accrued late fees.

     In the event that a toll amount cannot be determined by the authority, the authority may charge the maximum toll rate for the roadway on which the toll violation occurred.

     3.    This act shall take effect 90 days following enactment and shall expire 180 days after taking effect.

 

 

STATEMENT

 

     This bill requires the New Jersey Turnpike Authority (NJTA) and the South Jersey Transportation Authority (SJTA) to create a temporary amnesty program for any New Jersey resident charged with an outstanding violation for the non-payment of tolls or a violation of the toll collection monitoring system regulations for the electronic toll collection system, commonly known as E-ZPass.

     Under the bill, the amnesty program is to allow for any New Jersey resident charged with an outstanding violation for the non-payment of tolls or an E-ZPass violation, as of the effective date of the bill, to pay the tolls associated with the violation in full, within 180 days of the effective date of the bill, and to have certain administrative fees and accrued late fees related to the tolls waived.

     In the event that the NJTA or SJTA cannot determine the toll amount, the NJTA and SJTA may charge the maximum toll rate for the roadway on which the toll violation occurred.

     The bill requires the NJTA or SJTA to publish on every publicly accessible webpage of the New Jersey E-ZPass website and E-ZPass account holder account statements information concerning the amnesty program and the waiver of certain administrative fees and accrued late fees for a period of 180 days from the effective date of the bill.

     Lastly, the bill is to take effect 90 days following enactment and is to expire 180 days after taking effect.
