     Provides immunity from liability for certain persons who install or inspect child restraint systems.

An Act concerning immunity for certain persons who install or inspect child restraint systems and supplementing Title 2A of the New Jersey Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.  As used in this act:

     "State autonomous authority" means a public authority, board, commission, corporation, or other agency or instrumentality of this State allocated in but not of a principal department of State government pursuant to Article V, Section IV, paragraph 1 of the New Jersey Constitution. 

     b.  A person who is employed by a law enforcement agency, municipal, county or State government, a State autonomous authority, or who represents or is employed by a nonprofit corporation, society or association and who, in good faith, installs or inspects the installation of a child restraint system shall not be liable for any damages resulting from an act or omission related to such installation or inspection, provided:

     (1)  the act or omission was not the result of the person's gross negligence or willful omission; and

     (2)  the person has successfully met the minimum required training standards for installation of child restraint devices established by the National Highway Traffic Safety Administration of the United States Department of Transportation, or its designee.

 

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill provides immunity from liability to certain persons who in good faith install or inspect the installation of a child restraint system.  Under the bill's provisions, immunity is provided to persons employed by law enforcement agencies; municipal, county or State government; a State autonomous authority; or who represent or are employed by a nonprofit corporation, society or association.

     The bill provides protection from liability for any damages resulting from an act or omission related to that installation or inspection, unless the act or omission resulted from the person's gross negligence or willful omission.  The person also must meet the minimum required training standards for installation of child restraint devices established by the National Highway Traffic Safety Administration (NHTSA) or its designee.
