     Requires that newly-purchased school buses be equipped with air conditioning and heating systems.

An Act concerning school buses and supplementing Title 39 of the Revised Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    In addition to the requirements established pursuant to the Federal Motor Vehicle Safety Standards and notwithstanding the provisions of any State or federal law, rule, or regulation to the contrary, every school bus, as defined in R.S.39:1-1, that is purchased on or after the effective date of P.L.    , c.    (C.        ) (pending before the Legislature as this bill), shall be equipped with an air conditioning system and a heating system.  The type and installation of the air conditioning system and heating system shall conform to regulations to be promulgated by the Chief Administrator of the New Jersey Motor Vehicle Commission, in consultation with the State Board of Education, pursuant to the "Administrative Procedure Act," P.L.1968, c.410 (C.52:14B-1 et seq.).

 

     2.    This act shall take effect on the 180th day following enactment.

 

 

STATEMENT

 

     This bill requires that all school buses purchased on or after 180 days following the bill's enactment be equipped with an air conditioning system and a heating system.  The bill provides that the type and installation of the air conditioning and heating systems are required to conform to regulations to be promulgated by the Chief Administrator of the New Jersey Motor Vehicle Commission, in consultation with the State Board of Education.

     Under current State regulations, all school buses are required to be equipped with a heating system; however, an air conditioning system is optional.  This bill creates a statutory requirement that all school buses be equipped with both an air conditioning system and a heating system.
