     Establishes "COVID-19 Testing Transparency Act."

An Act concerning coronavirus disease 2019 testing.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    This act shall be known and may be cited as the "COVID-19 Testing Transparency Act."

 

     2.    a.   Prior to testing an individual for the coronavirus disease 2019, a public or private facility that performs coronavirus disease 2019 tests shall inform the individual of the timeframe in which he or she will receive test results and provide the individual the results of his or her coronavirus disease 2019 test within the timeframe specified by the facility. 

     b.    (1)   A public or private facility that performs coronavirus disease 2019 tests shall report to the Department of Health, on a monthly basis, the number of coronavirus disease 2019 tests administered by the facility and the average period of time between specimen collection and the provision of test results to a patient.

     (2)  Information that is reported by a public or private facility pursuant to paragraph (1) of this subsection shall be published on the Internet websites of both the Department of Health and the facility.

 

     3.    This act shall take effect immediately and shall expire upon the end of both the state of emergency and the public health emergency declared in response to the coronavirus disease 2019.

 

 

STATEMENT

 

     This bill establishes the "COVID-19 Testing Transparency Act."

     The bill provides that prior to testing an individual for the coronavirus disease 2019, a public or private facility that performs coronavirus disease 2019 tests is to inform the individual of the timeframe in which he or she will receive test results and provide the individual the results of his or her coronavirus disease 2019 test within the timeframe specified by the facility. 

     Under the bill, a public or private facility that performs coronavirus disease 2019 tests is to report to the Department of Health (department), on a monthly basis, the number of coronavirus disease 2019 tests administered by the facility and the average period of time between specimen collection and the provision of test results to a patient.  Information that is reported by a public or private facility to the department pursuant to the bill's provisions is to be published on the Internet websites of both the department and the facility.
