     Requires MVC to notify Medicaid if driver's license of medical transportation services provider is suspended or revoked.

An Act concerning medical transportation service providers and supplementing P.L.1968, c.413 (C.30:4D-1 et seq.) and Title 39 of the Revised Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.  An approved medical transportation services provider subject to the provisions of N.J.A.C.10:50-1.1 et seq. may provide the Division of Medical Assistance and Health Services in the Department of Human Services with the name and home address of every driver employed by the services provider, and a copy of the employee's New Jersey basic or commercial driver's license, as applicable.  A services provider who provides information to the division about its drivers shall promptly notify the division if a driver is terminated from employment with the services provider. The information shall be provided in a form and manner specified by the Commissioner of Human Services.

     Nothing in this subsection shall be construed to require an approved transportation services provider to submit the information about its drivers to the division.

     b.    The Director of the Division of Medical Assistance and Health Services shall compile the information submitted by the medical transportation services providers pursuant to this section, and provide the information to the Chief Administrator of the New Jersey Motor Vehicle Commission, or his designee.  The director shall provide the chief administrator with updates of the information on a monthly basis.

     c.     Upon receipt of notification from the New Jersey Motor Vehicle Commission pursuant to section 2 of P.L.  , c.  (C.    )(pending before the Legislature as this bill) that the driver's license of a driver employed by a medical transportation services provider has been suspended or revoked, the Director of the Division of Medical Assistance and Health Services shall so notify the applicable services provider and require the services provider to terminate the person from employment as a driver by the services provider.

     d.    The Commissioner of Human Services may assess medical transportation services providers a reasonable fee, based on the number of drivers the services provider employs, to reimburse the Division of Medical Assistance and Health Services and the New Jersey Motor Vehicle Commission, respectively, for the cost of processing and maintaining the information required pursuant to this act.

     e.     The Commissioner of Human Services shall, in accordance with the "Administrative Procedure Act," P.L.1968, c.410 (C.52:14B-1 et seq.), adopt such rules and regulations as the commissioner deems necessary to carry out the provisions of this act.

 

     2.    The Chief Administrator of the New Jersey Motor Vehicle Commission shall include the information concerning drivers of medical transportation services providers submitted by the Director of the Division of Medical Assistance and Health Services in the Department of Human Services pursuant to section 1 of P.L.  , c.  (C.    )(pending before the Legislature as this bill) in its driver's license database, and shall promptly notify the director if the basic or commercial driver's license of a person who is employed as a driver by a services provider is suspended or revoked.

 

     3.    This act shall take effect on the 120th day after enactment, but the Commissioner of Human Services may take such anticipatory administrative action in advance thereof as shall be necessary for the implementation of this act.

 

 

STATEMENT

 

     The purpose of this bill is to ensure that providers of medical transportation services under the Medicaid program are notified promptly when the driver's license of a driver employed by the provider is suspended or revoked.

     Specifically, this bill provides that:

·   An approved medical transportation services provider may provide the Division of Medical Assistance and Health Services in the Department of Human Services with the name and home address of every driver employed by the services provider, and a copy of the employee's New Jersey basic or commercial driver's license, as applicable.  Participation by the provider is voluntary.

·   Medicaid shall compile the information submitted by the medical transportation services providers, provide the information to the New Jersey Motor Vehicle Commission (MVC), and provide the MVC with updates of the information on a monthly basis.

·   Upon receipt of notification from the MVC that the driver's license of a driver employed by a medical transportation services provider has been suspended or revoked, Medicaid shall so notify the services provider and require the services provider to terminate the person from employment as a driver by the services provider.

·   The Commissioner of Human Services may assess medical transportation services providers a reasonable fee, based on the number of drivers the services provider employs, to reimburse Medicaid and the MVC, respectively, for the cost of processing and maintaining the information required pursuant to this bill.

·   The Chief Administrator of the MVC is required to include the information concerning drivers of medical transportation services providers submitted by Medicaid in its driver's license database, and promptly notify Medicaid if the basic or commercial driver's license of a person who is employed as a driver by a services provider is suspended or revoked.

·   The bill takes effect on the 120th day after enactment, but the Commissioner of Human Services is authorized to take such anticipatory administrative action in advance thereof as necessary for its implementation.
