An Act making a supplemental appropriation in an amount not to exceed $6,300,000 for certain supplemental grants for women's health services, supplementing the Fiscal Year 2012 annual appropriations act, P.L.2011, c. .
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. In addition to the amounts appropriated under P.L.2011, c. , the annual appropriations act for State fiscal year 2012, there is appropriated out of the General Fund the following sum for the purpose specified:

Notwithstanding the provision of any law or regulation to the contrary, there is appropriated an amount not to exceed $6,300,000 to the Department of Health and Senior Services for supplemental grants to county departments of health for the provision of women's health services, provided that the lead health officer of the county department of health has determined that there is an unmet need for women's health services in the county for low income or uninsured women, and provided further that no more than $300,000 shall be allocated to a single county. Provided however, in a county that does not have a county health department, the Commissioner of Health and Senior Services shall determine whether there is an unmet need for women's health services in that county for low income or uninsured women and shall designate one or more local health agencies, as defined pursuant to section 3 of P.L.1975, c.329 (C.26:3A2-3), in the county to receive supplemental grants for the provision of women's health services. None of the funds provided for supplemental grants for the provision of women's health services shall be used for abortion services.
2. This act shall take effect July 1, 2011 but remain inoperative until the date of enactment of P.L.2011, c. (the annual appropriation act for the State fiscal year ending on June 30, 2012).
STATEMENT
This bill makes a supplemental appropriation for fiscal year 2012 of up to $6.3 million, from resources certified by the Governor as available but not appropriated, to the Department of Health and Senior Services for certain grants to counties for women's health services.
Specifically, the bill appropriates an amount not to exceed $6.3 million to the Department of Health and Senior Services for supplemental grants to county departments of health for the provision of women's health services. To receive a grant, the lead health officer of the county department of health must determine that there is an unmet need for women's health services in the county for low income or uninsured women. No county may receive more than $300,000. For a county that does not have a county health department, the Commissioner of Health and Senior Services is empowered to determine whether there is such an unmet need for women's health services and designate one or more local health agencies in the county to receive such supplemental grants for the provision of women's health services. The bill denotes that none of the funds provided for supplemental grants for the provision of women's health services may be used for abortion services.
