     Creates Task Force on Construction Industry Workplace Safety and Health.

An Act creating a Task Force on Construction Industry Workplace Safety and Health.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.  There is created the "Task Force on Construction Industry Workplace Safety and Health," which shall be an independent body in, but not of, the Department of Labor and Workforce Development.  The task force shall consist of the Commissioner of Labor and Workforce Development, who shall serve ex officio, and 1[12] 131 members appointed by the Governor who shall include one person nominated by each of the following organizations: the Associated Construction Contractors of New Jersey; the Utility and Transportation Contractors Association of New Jersey; the New Jersey State Building and Construction Trades Council; the Associated Builders and Contractors of New Jersey; the Mechanical Contractors Association of New Jersey; New Jersey Citizen Action; the New Jersey Independent Electrical Contractors Association; the New Jersey Builders Association; the New Jersey Subcontractors Association; the New Jersey Work Environment Council; the New Jersey State AFL-CIO; 1the Insurance Council of New Jersey;1 and a New Jersey representative of the National Electrical Contractors Association.

     b.    The task force shall elect from its members a chairperson.  The task force may take action by an affirmative vote of a majority of its members.  A majority of the members of the task force shall constitute a quorum for the transaction of any business, for the performance of any duty, or for the exercise of any power of the task force.  Members of the task force shall serve without compensation, but may be reimbursed for the actual and necessary expenses incurred in the performance of their duties as members of the task force within the limits of funds appropriated or otherwise made available for that purpose.

     c.     The task force shall study and assess the impact of workplace safety and health policies and practices in the construction industry, and make recommendations for methods of improving safety and health in the industry, with particular attention to the option of establishing safety and health prequalification requirements for contractors bidding on public works contracts.

     d.    In furtherance of its evaluation, the task force may hold public meetings or hearings within the State on any matter or matters related to the provisions of this act, and call to its assistance and   avail  itself  of  the  services  of  the  employees  of  any  State

department, board, task force, agency, or institution of higher education which the task force determines possesses relevant data, analytical and professional expertise or other resources which may assist the task force in discharging its duties under this act. Each department, board, commission, agency or institution of higher education of this State is hereby directed, to the extent not inconsistent with law, to cooperate fully with the task force and to furnish such information and assistance as is necessary to accomplish the purposes of this act.  The task force shall submit a written report of its findings, including any recommendations regarding possible legislation or changes in administrative procedures based on its review and evaluation, to the Governor and to the Legislature not later than 12 months after the effective date of this act. The task force created under the provisions of this act shall expire upon the issuance of the report.

 

     2.    This act shall take effect immediately.
