An Act appropriating $23,000,000 from the "2009 Farmland Preservation Fund" and the "Garden State Farmland Preservation Fund" to the State Agriculture Development Committee for planning incentive grants to municipalities for farmland preservation purposes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.  There is appropriated to the State Agriculture Development Committee the following sums, totaling $23,000,000, for the purpose of providing planning incentive grants to municipalities pursuant to section 1 of P.L.1999, c.180 (C.4:1C-43.1) and approved as eligible for such funding pursuant to subsection b. of this section:

     (1)   $17,015,002 from the "2009 Farmland Preservation Fund," established pursuant to section 18 of the "Green Acres, Water Supply and Floodplain Protection, and Farmland and Historic Preservation Bond Act of 2009," P.L.2009, c.117; and

     (2)   $5,984,998 from the "Garden State Farmland Preservation Trust Fund," established pursuant to section 20 of the "Garden State Preservation Trust Act," P.L.1999, c.152 (C.13:8C-20), made available due to project withdrawals, canceled obligations, and reallocation of previously appropriated funds.

     b.    The following projects are eligible for funding with the monies appropriated pursuant to subsection a. of this section:

     2.    Of the monies appropriated or reappropriated pursuant to P.L.1999, c.138, P.L.2000, c.49, P.L.2000, c.78, P.L.2000, c.79, P.L.2000, c.168, P.L.2001, c.105, P.L.2001, c.181, P.L.2001, c.182, P.L.2001, c.185, P.L.2003, c.80, P.L.2003, c.81, P.L.2003, c.82, P.L.2003, c.83, P.L.2003, c.271, P.L.2003, c.272, P.L.2005, c.14, P.L.2005, c.15, P.L.2005, c.16, P.L.2005, c.181, P.L.2005, c.182, P.L.2006, c.71, P.L.2006, c.74, P.L.2007, c.185, and P.L.2009, c.93 from the "Garden State Farmland Preservation Trust Fund," established pursuant to section 20 of P.L.1999, c.152 (C.13:8C-20), the sum of $5,984,998 is made available due to project withdrawals, canceled obligations, and reallocation of previously appropriated funds.

 

     3.    The expenditure of the sums appropriated by this act is subject to the provisions and conditions of P.L.2009, c.117, P.L.1999, c.152 (C.13:8C-1 et seq.), P.L.1983, c.32 (C.4:1C-11 et seq.), and P.L.1999, c.180 (C.4:1C-43.1), as appropriate.

 

     4.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill would appropriate $23,000,000 to the State Agriculture Development Committee (SADC) for planning incentive grants to municipalities pursuant to a program established by P.L.1999, c.180 (C.4:1C-43.1) for farmland preservation purposes.

     Of this funding, $17,015,002 is from the "2009 Farmland Preservation Fund" and $5,984,998 is reappropriated from the "Garden State Farmland Preservation Trust Fund."  The "2009 Farmland Preservation Fund" was established pursuant to section 18 of the "Green Acres, Water Supply and Floodplain Protection, and Farmland and Historic Preservation Bond Act of 2009," P.L.2009, c.117, and the "Garden State Farmland Preservation Trust Fund" was established pursuant to the "Garden State Preservation Trust Act," P.L.1999, c.152 (C.13:8C-1 et seq.).

     This bill would provide grants to 43 municipalities in eight counties.

     The allocations and projects listed in this bill have been approved by the SADC and the Garden State Preservation Trust (GSPT).

     This bill would cancel certain prior appropriations totaling $5,984,998 for farmland preservation projects which have been made available due to project withdrawals, canceled obligations, and reallocation of previously appropriated funds, thereby making those moneys available for appropriation again to fund other farmland preservation projects.
