An Act concerning the regulation of emissions from outdoor wood burning units used to heat one-family and two-family residential units, and supplementing Title 26 of the Revised Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.  Notwithstanding any other law, or rule or regulation adopted pursuant thereto, to the contrary, outdoor wood burning units used to heat one-family or two-family residential units shall be subject to Department of Environmental Protection air quality regulation only in response to an air quality complaint.

     b.    For the purposes of this section, "outdoor wood burning unit" means a unit constructed outside of a residential unit that heats the residential unit by the combustion of wood, and includes units commonly referred to as "outdoor wood boilers," "outdoor wood burning furnaces," and "outdoor hydronic heaters."

 

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill provides that outdoor wood burning units used to heat one-family or two-family residential units are subject to Department of Environmental Protection air quality regulation only in response to an air quality complaint.  Under the bill, outdoor wood burning units include units commonly referred to as "outdoor wood boilers," "outdoor wood burning furnaces," and "outdoor hydronic heaters."
