SYNOPSIS

     Establishes a regulatory system to govern the sale and transfer of ammunition.

An Act regulating the sale and transfer of ammunition and supplementing chapter 58 of Title 2C of the New Jersey Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.  No person, other than a person duly licensed pursuant to federal law or under this chapter, shall sell or transfer any handgun, rifle, or shotgun ammunition unless the purchaser or recipient of that ammunition is authorized under the laws of this State to legally purchase and possess that ammunition. 

     A person purchasing or receiving rifle or shotgun ammunition shall display a valid form of picture identification, setting forth the purchaser or recipient's name, address and date of birth for the licensee at the time of the transfer.

     Sales and transfers of handgun ammunition shall be transacted pursuant to section 1 of P.L.2007, c.318 (C.2C:58-3.3).

     b.    The provisions of this section shall not apply to a collector of firearms or ammunition as curios or relics who purchases, receives, acquires, or transfers ammunition which is recognized as being historical in nature or of historical significance, or to any sale, transfer, assignment, or disposition of ammunition to or any purchase, receipt, or acceptance of ammunition by a law enforcement agency or law enforcement official for law enforcement purposes.

     c.     A person who violates this section shall be guilty of a crime of the fourth degree.

 

     2.    This act shall take effect on the first day of the second month following enactment.

 

 

STATEMENT

 

     This bill establishes a regulatory scheme for the sale and transfer of ammunition in New Jersey.

     Under the provisions of the bill, only State or federal licensed dealers may lawfully sell or transfer ammunition in New Jersey, and only individuals who are authorized under State law to purchase or possess ammunition may do so.

     A person purchasing or receiving rifle or shotgun ammunition must display a valid form of picture identification at the time of the transfer.

     Sales and transfers of handgun ammunition are to be transacted in accordance with current law (P.L.2007, c.318; C.2C:58-3.3).

     Law enforcement agencies and officials are exempted from the provisions of the bill, as are collectors when purchasing, acquiring, or transferring ammunition which is recognized as being historical in nature or of historical significance.

     The bill provides that violators are guilty of a crime of the fourth degree.  A crime of the fourth degree is punishable by imprisonment for a term of up to 18 months, a fine of up to $10,000, or both.
