     Permits 15 liquor licenses to be issued in three municipalities located in Fort Monmouth redevelopment area.

An Act concerning the issuance of plenary retail consumption licenses and supplementing Title 33 of the Revised Statutes

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    As used in this act, "authority," "host municipality," and "project area" shall have the same meaning as those terms are defined in section 3 of P.L.2010, c.51 (C.52:27I-20).

 

     2.    Notwithstanding the provisions of section 2 of P.L.1947, c.94 (C.33:1-12.14), the authority may issue five plenary retail consumption licenses to be used in each host municipality.  The licenses issued pursuant to this act only shall be used on a licensed premises within that portion of the host municipality that is situated within the project area.

 

     3.    The authority shall conduct a public sale and issue the licenses created pursuant to this section to the highest qualified bidder.  A license shall not be issued to any person who would not qualify as a licensee pursuant to Title 33 of the Revised Statutes and rules and regulations of the director. 

 

     4.    A plenary retail consumption license issued pursuant to this act shall not be transferred for use on a licensed premises that is not located in the project area.

 

     5.    Pursuant to the "Administrative Procedure Act," P.L.1968, c.410 (C.52:14B-1 et seq.), the director, in consultation with the authority, shall promulgate regulations necessary to effectuate the provisions of this act.

 

     6.    This act shall take effect on the first day of the seventh month after enactment.

 

 

STATEMENT

 

     This bill authorizes the issuance of 15 additional plenary retail consumption licenses in the area that formerly comprised Fort Monmouth. 

     The bill permits the Fort Monmouth Economic Revitalization Authority, established pursuant to P.L.2010, c.51 (C.52:27I-18 et seq.), to issue five plenary retail consumption licenses to qualified persons in each of the three municipalities wherein Fort Monmouth was located--Oceanport, Eatontown, and Tinton Falls.  The authority is charged with redeveloping and revitalizing the area that comprised Fort Monmouth.

     The licenses issued pursuant to this bill could be used only on a licensed premises located in a portion of the municipality situated within the boundaries of Fort Monmouth.

     The bill requires the authority to conduct a public sale and issue the licenses to the highest qualified bidders.

     After serving as a United States Army base for 94 years, Fort Monmouth closed in 2011 as part of a federal cost-cutting measure.
