SYNOPSIS

     Requires AOC to develop, prepare, and distribute educational fact sheet on PROMIS GAVEL network.

An Act concerning criminal record checks and supplementing P.L.1994, c.54 (C.2B:1-4).

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.  The Administrative Office of the Courts shall develop and prepare, both in print and in an easily printable format, an educational fact sheet on the PROMIS GAVEL network. The Administrative Office of the Courts shall update the fact sheet whenever new information about the PROMIS GAVEL network becomes available.  The fact sheet shall include, but not be limited to, information on:

     (1)   the PROMIS GAVEL network and the statutory law establishing the court's automated data processing system that allows for public access to certain court information;

     (2)   the court records contained on the PROMIS GAVEL network that can be accessed by the public;

     (3)   the location of public access terminals where the PROMIS GAVEL network can be accessed; and

     (4)   how a person can access the PROMIS GAVEL network on a personal or portable computer.

     b.    The Administrative Office of the Courts shall distribute the educational fact sheet developed pursuant to subsection a. of this section, at not cost, to county and municipal courts, State colleges and universities, libraries, community-based organizations that provide child welfare services, for distribution to parents and guardians of children receiving such services, domestic violence shelters, and community-based outreach programs and organizations that provide legal advocacy services.  The Administrative Office of the Courts shall publicize and make available the information contained in the fact sheet on the New Jersey Courts Internet website, and shall update the information as necessary.

     c.     The Administrative Office of the Courts shall ensure that any information on, or website link posted to, the PROMIS GAVEL network already available on the New Jersey Courts Internet website shall be easily accessible to the public and prominently displayed on the website.

     d.    As used in this section, "PROMIS GAVEL network" means the automated criminal case tracking system supported by the Administrative Office of the Courts that captures information on defendants who have been charged with indictable offenses and tracks the processing of the defendants from initial arrest to the adjudication of their offenses.

 

     2.    This act shall take effect immediately.


STATEMENT

 

     This bill requires the Administrative Office of the Courts (AOC) to develop and prepare, both in print and in an easily printable format, an educational fact sheet on the PROMIS GAVEL network.    The AOC would update the educational fact sheet whenever new information about the PROMIS GAVEL network becomes available.

     As used in the bill, "PROMIS GAVEL network" means the automated criminal case tracking system supported by the AOC that captures information on defendants who have been charged with indictable offenses and tracks the processing of the defendants from initial arrest to the adjudication of their offenses.

     Under the provisions of the bill, the fact sheet would include, but not be limited to, information on:  the PROMIS GAVEL network and the statutory law establishing the court's automated data processing system that allows for public access to certain court information; the court records contained on the PROMIS GAVEL network that can be accessed by the public; the location of public access terminals where the PROMIS GAVEL network can be accessed; and how a person can access the PROMIS GAVEL network on a personal or portable computer.

     The AOC would be required to distribute the educational fact sheet, at not cost, to county and municipal courts, State colleges and universities, libraries, community-based organizations that provide child welfare services, for distribution to parents and guardians of children receiving such services, domestic violence shelters, and community-based outreach programs and organizations that provide legal advocacy services..

     Finally, the AOC would also: publicize and make available the information contained in the fact sheet on the New Jersey Courts Internet website, and update the information as necessary; and ensure that any information on, or website links posted to, the PROMIS GAVEL network already available on the website would be easily accessible to the public and prominently displayed.
