SYNOPSIS
Permits certain elected municipal officials to be deemed retired for pension purposes upon forfeiting compensation for that position.

An Act concerning the retirement of certain elected municipal officials and supplementing P.L.1954, c.84 (C.43:15A-1 et seq.) and P.L.2007, c.92 (C.43:15C-1 et seq.).
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. a. Notwithstanding any law, rule, or regulation to the contrary, a member of the retirement system who is serving as an elected public official of a municipality in this State on the effective date of P.L. , c. (C. ) (pending before the Legislature as this bill) shall be eligible to retire while holding that elected public office if the retirement allowance is not based solely on the member's service in that elected public office and if the member voluntarily forfeits, and ceases to receive, any compensation associated with that elected public office.
b. The Department of the Treasury shall promulgate rules and regulations, pursuant to the "Administrative Procedure Act," P.L.1968, c.410 (C.52:14B-1 et seq.), necessary to effectuate the purposes of this section.
c. This section shall be effective if the qualified status of the retirement system under federal law can be maintained upon its application, and such modifications to the program as may be available shall be made to allow for its application.
2. a. (C. ) (pending before the Legislature as this bill) shall be eligible to retire while holding that elected public office if the retirement allowance is not based solely on the participant's service in that elected public office and if the participant voluntarily forfeits, and ceases to receive, any compensation associated with that elected public office.

3. This act shall take effect
immediately.
STATEMENT
This bill permits elected public officials of a municipality in this State to be eligible to retire while holding that elected public office if the retirement allowance is not based solely on their service in that elected public office and if they voluntarily forfeit, and cease to receive, any compensation associated with that elected public office. The bill stipulates that this law will be effective if the qualified status of the retirement system or program under federal law can be maintained upon its application, and modifications that may be available will be made to allow for its application.
