SYNOPSIS

     Requires the placement of defibrillators in public school buildings.

An Act concerning the placement of defibrillators in public school buildings and supplementing chapter 40 of Title 18A of the New Jersey Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.  Each public school district shall supply and maintain an automated external defibrillator, as defined in section 2 of P.L.1999, c.34 (C.2A:62A-24), on-site in each school building.  The defibrillator shall be maintained in an accessible location within the building and shall be made available during the normal school day and for extracurricular activities, such as athletics and social or academic clubs, that occur at the school. The district shall ensure that the defibrillator is tested and maintained and shall provide notification to the appropriate first aid, ambulance or rescue squad or other appropriate emergency medical services provider of the type and location of the defibrillators in accordance with the provisions of section 3 of P.L.1999, c.34 (C.2A:62A-25).

     b.    Each public school district shall arrange for the training in cardio-pulmonary resuscitation and the use of a defibrillator for school nurses, athletic trainers, and any other staff members designated by the district.  The training shall be in accordance with the provisions of subsection a. of section 3 of P.L.1999, c.34 (C.2A:62A-25).

 

     2.    a.  The administrator responsible for a public school building shall ensure the presence of a staff person who is certified in the operation and use of an automated external defibrillator, pursuant to section 4 of P.L.1999, c.34 (C.2A:62A-26), whenever the public school building is used for school-sponsored or school-approved curricular or extracurricular events or activities.

     b.    A public school district and its employees shall be immune from civil liability in the acquisition and use of defibrillators pursuant to the provisions of section 5 of P.L.1999, c.34 (C.2A:62A-27).

 

     3.    The State shall reimburse a public school district for the cost of purchasing and maintaining a defibrillator on-site in each school building and for training staff in cardio-pulmonary resuscitation and the proper use of a defibrillator.

 

     4.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill requires each public school district to supply and maintain  an automated external defibrillator on-site in each school building.  The district is required to maintain the defibrillator in an accessible location within the building and ensure its availability during the normal school day and for extracurricular activities, such as athletics and social or academic clubs, that occur at the school. The district must ensure that the defibrillator is tested and maintained and is required to provide notification to the appropriate first aid, ambulance or rescue squad or other appropriate emergency medical services provider of the type and location of the defibrillators.

      The bill also requires an administrator responsible for a public school building to ensure the presence of a staff person who is certified in the operation and use of an automated external defibrillator whenever the public school building is used for school-sponsored or school-approved curricular or extracurricular events or activities.  The bill specifies that a public school district and its employees are immune from civil liability in the acquisition and use of defibrillators pursuant to the provisions of section 5 of P.L.1999, c.34 (C. A:62A-27).

     The bill specifies that the State is required to reimburse a public school district for the cost of purchasing and maintaining a defibrillator on-site in each school building and for training staff in cardio-pulmonary resuscitation and the proper use of a defibrillator.
