SYNOPSIS

     Requires law enforcement officers to search domestic violence restraining order registry upon conducting an arrest.

An Act concerning the use of the domestic violence restraining order registry by certain law enforcement officers and supplementing P.L.1999, c.421.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.  A police officer, member of the State police, or other law enforcement officer authorized to conduct an arrest shall, upon each arrest, determine if any domestic violence restraining order has been entered against the arrested person.  The determination shall include a search of the central registry created pursuant to section 1 of P.L.1999, c.421 (C.2C:25-34).

     b.    The Attorney General and the Supreme Court of New Jersey may adopt rules to implement the provisions of this act.

 

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill would require a police officer to determine, upon each arrest, if the person arrested has had a domestic violence restraining order entered against them.  This determination shall include a search of the central registry of all persons who have had domestic violence restraining orders entered against them.  The central registry referred to in the bill is maintained by the Administrative Office of the Courts pursuant to section 1 of P.L.1999, c.421 (C.2C:25-34).
